Personalidade Jurídica: redimensionamento do conceito à luz da perspetiva personalista

Abstract

RESUMOA personalidade jurídica assume-se como um conceito central do ordenamento jurídico, em geral, e do direito civil, em particular. Nem por isso, contudo, são poucas as críticas que se têm dirigido à categoria. Com raízes no conceptualismo germânico, não raro ouvem-se vozes no sentido de contestar um caráter demasiado formal com que a mesma surge revestida. Nas páginas que se seguem procuraremos refletir sobre este conceito, desde a sua génese até aos nossos dias. O exercício revela-se fundamental por diversos motivos. Na verdade, são muitas as zonas de fronteira onde surgem dúvidas acerca da possível atribuição de personalidade jurídica a determinados entes. A resposta que se possa oferecer a cada um desses problemas é tributária do modo como olhamos para a categoria e da forma como a articulamos com o próprio sentido do direito.O presente trabalho versa sobre o conceito da personalidade jurídica. Em face dos desafios lançados pelo aparecimento de novos putativos sujeitos, impõe-se uma reflexão acerca da sua extensão, ao mesmo tempo que se indaga se o conceito é meramente operativo ou eivado de uma intencionalidade material.Para tanto, analisaremos o contexto da sua emergência histórica, dialogaremos com a doutrina e procuraremos determinar o sentido e os limites da personalidade jurídica por referência às pessoas singulares e às pessoas coletivas. O exercício conduz-nos à ponderação do direito enquanto afirmação de uma validade. Impondo-se o salto para o patamar da axiologia, estaremos em condições não só de entender os específicos contornos da categoria, como de dar resposta a complexos problemas, como seja o do estatuto jurídico do nascituro, ao mesmo tempo que encontramos pontos de apoio seguros para pensar nos novos problemas que se discutem: o da eventual subjetivação dos animais e dos entes dotados de inteligência artificial.

Legal personality is assumed to be a central concept of the legal system in general and civil law in particular.Not so, however, there are few criticisms that have been directed at the category. Rooted in Germanic conceptualism, voices are not often heard in order to challenge an overly formal character with which it appears coated. In the following pages we will seek to reflect on this concept, from its genesis to our day. The exercise is fundamental for several reasons. In fact, there are many border areas where doubts arise about the possible attribution of legal personality to certain entities. The answer that can be offered to each of these problems is tax ing the way we look at the category and the way and the way we articulate it with the very sense of right.The present dissertation deals with the concept of juridical personality. In face of the emerging challenges posed by the emergence of alleged new subjects of the juridical relationship, a careful reflection is required concerning the extension of the concept. Furthermore, we must question if the mentioned concept is only an operative concept or, otherwise, if it has a material content. For this purpose, we will analyse the context of its historical emergence, as well as dialogue with the doctrine and seek to determine the meaning and limits of juridical personality by reference to natural persons and legal persons.The exercise allows us to think in law as a validity. And, as axiological presupposition is necessary, we will find a way to understand juridical personality, as well as to solve complex problems, as the unborn juridical status. In the meanwhile, we will find support to reflect about the new problems that are being discussed and that we announced in the begging: the eventual subjectivation of animals and artificial intelligence mechanisms.
