Abstract: ResumoO direito do urbanismo ”regula as mais importantes formas de intervenção nos solos, integrando necessariamente as normas definidas dos parâmetros urbanísticos, quer sejam emanadas pelo Estado, quer pelas Autarquias Locais …”.E, “as operações de loteamento, são importantes formas de intervenção nos solos (…) com incidências acentuadas ao nível do ordenamento do território, do ambiente, recursos naturais, (…) com repercussões na qualidade de vida dos cidadãos”.O direito do urbanismo, como ramo específico do direito administrativo, vocacionado para a ocupação urbana dos solos, materializa-se no caso concreto, numa das operações de transformação fundiárias mais importantes - os Loteamentos Urbanos, com regulação específica a prevista no Regime Jurídico da Urbanização e Edificação (RJUE), sujeitos a controlo prévio da administração local. Pretende-se proteger o interesse público, (com estes procedimentos específicos do direito administrativo) e simultaneamente permitir o exercício de direitos privados (ao autorizar o fraccionamento e edificação).O registo predial, como ramo específico do direito, “dá publicidade à situação juridica dos prédios, tendo em vista a segurança do comércio jurídico imobiliário”(art. 1º CRP), pretende salvaguardar “os direitos legalmente protegidos dos cidadãos” e “proteger terceiros”. Esta publicidade tem Fé Pública, o que significa que as inscrições beneficiam da presunção legal de verdade e exactidão o que permite a segurança do comércio jurídico imobiliário. And, "subdivision operations are important forms of intervention in the soil (...) with marked effects on the level of spatial planning, the environment, natural resources, (...) with repercussions on the quality of life of citizens". The law of urbanism, as a specific branch of administrative law, aimed at urban land occupation, materializes in the specific case, in one of the most important land transformation operations - Urban Allotments, with specific regulation to that provided for in the Legal Regime of Urbanization and Building (RJUE), subject to prior control by the local administration. It is intended to protect the public interest, (with these specific procedures of administrative law) and simultaneously allow the exercise of private rights (by authorizing fractionation and building). The land registry, as a specific branch of law, “publicizes the legal situation of buildings, with a view to the security of the legal real estate trade” (art. 1 CRP), aims to safeguard “the legally protected rights of citizens” and “protect third parties”. This advertising has Public Faith, which means that inscriptions benefit from the legal presumption of truth and accuracy, which allows the security of the legal real estate trade. Thus, once an urban allotment permit has been registered, the respective descriptions open (buildings are created), the most varied rights and charges can be registered on them. These two aspects of facing the same reality - the soil, the building, its description - under which a set of rights - public and private - will be protected and safeguarded, by the law of urbanism (administrative) and registration law (and civil law), must be reconciled guaranteeing unity of the legal system and simultaneously progress in the way the territory is protected and private rights are safeguarded, maintaining security and confidence in the legal real estate trade, (these are the aspects that we will analyze in the work that follows).
