Abstract: A Lei n.º 25/2016 – que procedeu à terceira alteração da lei que regula a procriação medicamente assistida – vem regular o acesso à gestação de substituição em Portugal. Admite-se, assim, que, em situações excecionais, uma mulher que não pode ou não consegue carregar um filho biológico no seu útero, recorra a outra mulher, a gestante de substituição, para que esta lhe gere esse bebé – sem que tenha fornecido os seus ovócitos – a fim de lho entregar no final da gestação, abdicando assim de todos os poderes e deveres inerentes à maternidade. Confrontamo-nos com uma situação que, apesar de transmitir uma imagem de altruísmo e de solidariedade, mais não se reporta a uma instrumentalização da mulher gestante, que, apesar de assim não o entender, assume uma posição de simples incubadora durante todo o processo da gestação. A gestante, a partir de determinado momento, ainda que se arrependa, não pode revogar o seu consentimento. Além disso, mais gritante é o facto de a lei, em momento algum, fazer referência ao superior interesse da criança que será gerada nestes termos. Estamos perante a celebração de um contrato cujo objeto de negociação é uma pessoa, um bebé. Bebé este que, ainda que não tenha sido já concebido, encontra-se já numa posição de instabilidade, não só jurídica como eventualmente emocional. A criança, no final, poderá ser tratada por um produto querido por todos, ou, a contrario, querida por ninguém. A sua dignidade é totalmente descredibilizada. O fenómeno da gestação, além de estar mal regulamentado, atenta contra direitos de personalidade.
Law no. 25/2016, of August 22 – which made the third amendment to the law that regulates medically assisted procreation – regulates access to surrogacy in Portugal. Thus, it is admitted that, in exceptional situations, a woman who is unable to carry a biological child in her uterus, resorts to another woman, the surrogate mother, to carry a baby in her womb – without having provided her oocytes – in order to hand him over at the end of pregnancy. We are faced with a situation that, despite transmitting an image of altruism and solidarity, no longer refers to the instrumentalization of pregnant women, who, despite neglecting it, assumes a position of mere incubator throughout the process of gestation. The pregnant woman, from a certain moment, even if she regrets, cannot revoke her consent. Furthermore, what is even more striking is the fact that the law, at no time, refers to the best interests of the child that will be generated in these terms. We are facing the conclusion of a contract, whose object of negotiation is a person, a baby. A baby who, even though he has not been conceived, he is already in a position of instability, not only legal but also emotional. In the end, the child may be treated as a product that is liked by everyone, or, conversely, by no one. Their dignity is totally discredited. The phenomenon of pregnancy, in addition to being poorly regulated, threatens personality rights.----------------------------------------------------------------------------------------------------------------------------------------------------
