A Criminalização do Aborto por Negligência

Abstract

O objeto de estudo da presente dissertação é a possível criminalização do aborto por negligência no ordenamento jurídico português.Conforme decorre da norma do artigo 13.º do Código Penal, um facto é punível a título de negligência apenas nos casos expressamente previstos na lei.Atualmente, em Portugal, o referido diploma apenas prevê o crime de aborto na forma dolosa, no seu artigo 140.º, não se tendo pronunciado o legislador português relativamente a um crime de aborto por negligência. Ou seja, daqui resulta que um sujeito que adote uma conduta negligente que resulte na morte do feto não incorre em qualquer responsabilidade criminal.No entanto, tendo em conta os bens jurídicos em causa neste contexto, sobretudo a vida intra-uterina, que é um bem de primeira ordem, consagrado no artigo 24.º da Constituição da República Portuguesa, não parece justo que este não beneficie de tutela penal quando é lesado por condutas negligentes.Neste contexto surgem duas questões a que se pretende dar resposta nesta dissertação: a primeira prende-se com os casos em que o agente do crime é um profissional de saúde e o aborto ocorre no âmbito do exercício da sua atividade profissional e a segunda tem que ver com as situações em que a morte do feto é consequência de comportamentos negligentes levados a cabo pela própria mulher grávida.Para concretizar o objetivo proposto, começarei por fazer uma breve abordagem à figura da negligência, seguida de um, também breve, estudo do crime de aborto doloso, de forma a enquadrar um possível crime de aborto por negligência no ordenamento jurídico português, fazendo ainda referência à solução consagrada no Código Penal Espanhol.

The object of study of this dissertation is the possible criminalization of negligent abortion in the Portuguese legal system.As is clear from the rule in the Article 13.º of the Penal Code, a fact is punishable by way of negligence only in the cases expressly provided by the law.Currently, in Portugal, the refered diploma only provides the crime of abortion in its Article 140, and the Portuguese legislature has not pronounced itself on a crime of negligent abortion.In other words, it follows that a person who adopts negligent conduct that results in the death of the fetus does not incur in any criminal liability.However, taking into account the legal assets in question in this context, especially intra-uterine life, which is a first-rate asset, enshrined in Article 24 of the Constitution of the Portuguese Republic, it does not seem fair that it does not benefit from protection when it is injured by negligent conducts.In this context, two questions arise that are intended to be answered in this dissertation: the first concerns the cases in which the person who commits the crime is a health professional and abortion occurs within the scope of his professional activity and the second has to to do with situations in which the death of the fetus results of negligent behaviors carried out by the pregnant woman herself.To achieve the proposed goal, I will start by making a brief reference to the figure of negligence, followed by a also brief study of the crime of abortion in order to frame a possible crime of negligent abortion in the Portuguese criminal law. At last, I also will mention the solution enshrined in the Spanish Penal Code.
