Abstract

Processos de abertura: Os direitos humanos como fundamento da interconstitucionalidade: O presente trabalho visa a promover uma reflexão acerca da teoria da interconstitucionalidade, de Canotilho, o que realiza por meio do enfoque da teoria crítica dos direitos humanos. Para tanto, opera, de início, uma digressão histórica acerca da construção filósofica dos direitos humanos, até seu processo de internacionalização, no segundo pós-guerra mundial. A seguir, realiza uma análise acerca do atual estágio da globalização e de suas inflexões sobre a soberania estatal e sobre as Constituições. Frisa-se, nesse contexto, a convergência entre as ordens constitucionais operada, sobretudo no Ocidente, sob a influência da Declaração Universal dos Direitos Humanos. Após um breve exame dos possíveis efeitos da conjuntura excepcional do ano de 2020 sobre o paradigma inaugurado no pós-segunda guerra, aborda a crise do Estado Social e a atual insuficiência de sua proposta, sobretudo ante a interconexão global. Articulando-se o quadro atual de integração interestatal com a globalização, dedica-se ao estudo da interconstitucionalidade, contextualizada com outras construções teóricas de enfoque análogo, com ênfase para a interculturalidade. Por fim, reflete sobre a convergência entre a interconstitucionalidade e os direitos humanos, como produtos culturais e processos de abertura, de modo que, a par das premissas comuns, propõe-se que os direitos humanos figuram como o fundamento da interconstitucionalidade.

Opening Processes: Human rights as the foundation of interconstitutionality: The present work aims to promote a reflection on Canotilho`s theory of interconstitutionality, through the lens of human rights critical theory .To this end, it operates, initially, a historical digression about the philosophical construction of human rights, until its internationalization process, in the the post-Second World War. Next, it analyzes the current stage of globalization and its inflections on state sovereignty and on the Constitutions. In this context, it emphasizes the convergence between constitutional orders operated, especially in the West, under the influence of the Universal Declaration of Human Rights. After a brief examination about the possible effects of the exceptional situation of the year 2020 on the paradigm inaugurated in the post-World War II, it addresses the crisis of the Welfare State and the current insufficiency of its proposal, especially in the face of global interconnection. Articulating the current framework of inter-state integration with globalization, it dedicates to the study of interconstitutionality, contextualized with other theoretical constructions of similar focus, with an emphasis on interculturality. Finally, it reflects on the convergence between interconstitutionality and human rights, as cultural products and processes of openness, so that, along with the common premises, it proposes that human rights figure as the foundation of interconstitutionality.
