Abstract: Nos termos do artigo 88.º da Constituição da República de Angola, todos têm o dever de contribuir para as despesas públicas e da sociedade em função da sua capacidade económica e dos benefícios que aufiram através dos impostos e taxas, com base num sistema tributário justo e nos termos da lei. Por conseguinte, o cumprimento do dever de pagamento dos impostos a que se refere o artigo supracitado pode ser feito de forma voluntária ou coerciva. Constando que a forma coerciva se materializa mediante um processo especial de execução fiscal, cuja natureza tem se apresentado como uma “vexata quaestio” face aos actos praticados pelos órgãos judiciais e administrativos.Sob esta perspectiva, o estudo do nosso trabalho debruçou-se sobre a natureza do processo especial de execução fiscal, fazendo constar deste, a natureza judicial, a administrativa e a mista ou híbrida.E em apreciação à ordem jurídica angolana, é possível depreender que o processo especial de execução fiscal tem uma natureza mista, atípica ou híbrida, apesar de ser declarada judicial, na medida em que é caracterizada por momentos ou fases judiciais e administrativas, reflectindo o desvio que o legislador ordinário introduziu neste processo em relação ao que se verifica habitualmente em outros processos, pois naquele nem todos os actos são de natureza jurisdicional, pese embora, a sua natureza assim se apresente. No mesmo prisma efectuamos estudos comparados, e verificamos que em Portugal o processo de execução fiscal tem uma natureza judicial, pese embora, o órgão administrativo tenha poder de nalguns casos, começar e extinguir o referido processo. Sobre o mesmo assunto, verificamos igualmente a realidade espanhola, e constatamos que o referido processo é designado por Apremio e tem uma natureza exclusivamente administrativa.
Under article of 88.º the Constitucion of the Republic of Angola, everyone has a duty to contribute to public and society expenses according to their economic capacity and the benefits they receive through taxes and fees, based on a fair tax system and under the terms of law.Therefore, the fulfillment of the duty to pay taxes referred to in the aforementioned article can be done voluntarily or coercively. Noting that the coercive form materializes through a special tax enforcement process, the nature of which has been presented as a “vexata quaestio” due of the acts performed by the judicial and administrative bodies. From this perspective, the study of our work focused on the nature of the special tax enforcement process, including the judicial, administrative and mixe dor hybrid nature.And in the light of the Angolan legal order, it is possible to conclude that the special tax enforcement process has a mixed, atypical or hybrid nature, insofar as it is characterized by judicial and administrative moments or phases, reflecting the deviation that the ordinary legislator introduced in this case in relation to what is usually seen in other cases, since in that case not all acts are of a judicial nature, despite their nature.In the same light, after comparative studies, we realize that in Portugal we can find a judicial nature tax enforcement process, despite the fact that the administrative authority has the power in some cases to initiate and extinguish referred process. On the same subject, we also verified that in Spanish reality, we can find that the referred process is designated as Apremio and has an exclusively administrative nature.
