dc.description.abstract | A presente dissertação tem como objetivo analisar a influência das redes sociais no contexto laboral, mais especificamente o exercício do direito à liberdade de expressão, por parte do trabalhador, através destas plataformas e a interferência gerada na relação com o empregador. É certo que nem mesmo os direitos fundamentais são absolutos, podendo ser limitados de forma a coexistirem com outros direitos, e nesse sentido após uma contextualização histórica sobre os mesmos, é importante entender qual o limite imposto aos limites. Até onde podemos limitar os direitos fundamentais para que consigamos o duplo objetivo desta limitação: o não esvaziamento de sentido do direito e o seu exercício de forma respeitosa por outros direitos com que entre em colisão. Entendemos que o princípio da proporcionalidade é um elemento norteador nestas situações, e por isso merecedor de estudo. Consecutivamente, o exercício destes direitos na relação laboral importa um exame aprofundado do Contrato Trabalho, instituto gerador de direitos e deveres entre duas partes que apesar de possuírem interesses coincidentes, se encontram numa relação desequilibrada. Desequilíbrio este que deve sempre ser tido em conta quando discorremos sobre o mundo laboral. Finalmente teremos que entender o fenómeno das redes sociais e a forma como o exercício do direito à liberdade de expressão nestas pode influenciar negativamente a relação laboral, resultando em consequências graves para ambas as partes. A possível lesão da honra e imagem do empregador, e o despedimento do trabalhador, como sanção mais penalizadora do nosso ordenamento jurídico, e por isso, apenas utilizada em última instância.Palavras-chave: Contrato de Trabalho, Redes Sociais, Facebook, Despedimento, Poder Diretivo, Poder Fiscalizador, Poder Disciplinar, Liberdade de Expressão, Direitos Fundamentais, Proporcionalidade. | por |
dc.description.abstract | This dissertation aims to analyze the influence of social networks in work context, more specifically the exercise of the right of freedom of speech, by the employee, through these platforms and the interference generated in the relationship with the employer. It is true that not even fundamental rights are a hundred per cent absolute and in order to coexist with other rights it can be limited, and in that sense after a historical contextualization about them, it is important to understand the limit imposed. How far can we limit fundamental rights so that we can achieve double objective of this limitation: the non-emptying of the meaning of the law and its exercise respectfully for other rights with which it collides. We understand that the principle of proportionality is a guiding element in these situations, and therefore worthy of study. Consecutively, the exercise of these rights in the employment relationship thorough examination of the Employment Contract, an institute that generates rights and duties between the two parties that despite having coincident interests, are in a relationship that is unbalanced. This unbalance must always be taken into account when we talk about the working world. Finally, we have to understand the phenomenon of social networks and the way in which exercising the right of freedom of speech in and how it may negatively influence the employee-employer relationship, which can result in serious consequences for both parts.
