Abstract: Esta tese, que apresentamos como resultado final do doutoramento em “Direito, Justiça e Cidadania no Século XXI”, realizado no Centro de Estudos Sociais da Universidade de Coimbra, visa, por meio de uma abordagem multidisciplinar, compreender a construção da capacidade institucional local de direitos humanos. Considerando a proposta do referido programa de doutoramento de refletir a respeito de conceitos como Direito, Justiça e Cidadania na contemporaneidade, desenvolvemos nossa investigação sobre as instituições públicas de direitos humanos, em três níveis territoriais – internacional, nacional e local –, e acrescentamos um olhar a respeito da Administração Pública voltada para os direitos humanos às abordagens típicas do Direito e da Sociologia. Desde que se estabeleceu a Declaração Universal dos Direitos Humanos – que utilizamos como marco histórico institucional primordial – até os dias de hoje, são notórias as discussões académicas, políticas e jurídicas sobre os direitos humanos enquanto agenda internacional, conflito judicial ou pauta de movimentos sociais. Com esta tese, almejamos enriquecer o debate, colocando o foco da investigação nas instituições públicas de direitos humanos, especialmente nas de âmbito local, que nem sempre são tidas em conta como atores relevantes para a promoção de referidos direitos. Afirmamos que a agenda dos direitos humanos se conforma como um processo dinâmico que passa pelo estabelecimento de normas internacionais na matéria (compromisso) e pela internalização normativa dos documentos internacionais para o plano nacional. Entretanto, a efetivação dos direitos humanos (cumprimento) é observável sobretudo no plano local e depende da capacidade institucional. Valemo-nos dos estudos de casos contextuais e comparados de Brasil e de Portugal, abordando suas instituições nacionais de direitos humanos e políticas nacionais de direitos humanos. Aprofundamos nossa análise com o estudo de caso específico da área governamental voltada para os direitos humanos da Prefeitura do Município de São Paulo (Brasil) e suas políticas públicas especializadas. A fim de compreender o desenvolvimento da capacidade institucional local de direitos humanos, analisamos os recursos normativos, materiais, humanos e instrumentais da Comissão Municipal de Direitos Humanos e da Secretaria Municipal de Direitos Humanos e Cidadania, ambos órgãos do município de São Paulo, entre os anos 2002 e 2018. Assim, foi-nos possível traçar uma narrativa da história institucional dos direitos humanos no município paulistano, bem como concretizar uma análise crítica de aspetos discursivos e comunicacionais que envolvem a gestão governamental especializada em direitos humanos. Transpusemos a teoria Neo-Institucionalista, principalmente as correntes histórica e discursiva, para analisar o estudo de caso de referidas instituições públicas municipais, pois essa ótica trata as instituições como atores políticos relevantes para a compreensão da sociedade, enquanto escala intermediária entre os indivíduos e o Estado como um todo. O estudo de caso, ao fim, demonstra o desafio e ao mesmo tempo a grande importância de se consolidar uma instituição pública no governo municipal voltada a implementar políticas públicas de direitos humanos. Pois são temas que não se encontram de todo contemplados nas políticas públicas realizadas por outros órgãos governamentais e exigem inovação para que os direitos humanos sejam parte substancial (o que deve ser feito, que direito deve ser promovido) e procedimental (como deve ser feito, quais princípios de direitos humanos devem ser seguidos) das políticas públicas. Esperamos que as reflexões desta tese contribuam para que os mais diversos atores envolvidos na agenda de direitos humanos sensibilizem-se com a importância de os contextos locais serem significativamente levados em conta no estabelecimento de normas internacionais de direitos humanos, a fim de que essas normas sejam instrumento para o desenvolvimento da capacidade institucional local para promoção dos direitos humanos.
This thesis, which we present as the final result of the doctorate in “Law, Justice and Citizenship in the 21st Century”, carried out at the Center for Social Studies of the University of Coimbra, through a multidisciplinary approach, aims to understand the local institutional capacity building of human rights. Considering the proposal of this PhD program to reflect on concepts such as Law, Justice and Citizenship nowadays, we developed our research on human rights public institutions at three territorial levels – international, national and local – and added a Public Administration point of view to the typical approaches of Law and Sociology. Since the Universal Declaration of Human Rights – our primary institutional historical mark – until today, academic, political and legal discussions mostly deal with human rights as an international agenda, judicial conflict or agenda of social movements. With this thesis we aim to enrich the debate by placing the focus of research on human rights public institutions, especially those at the local level, which are not always considered as relevant actors for the promotion of such rights. We affirm that the human rights agenda is a dynamic process that involves the establishment of international norms on the subject (commitment), the normative internalization of the international document to the national level. However, the realization of human rights (compliance) is only observable at the local level and depends on institutional capacity. We draw on contextual case studies on Brazil and Portugal, addressing the national human rights institutions and the national human rights policies of these countries. We deepen our analysis with the specific case study of the governmental area focused on human rights of the Municipality of São Paulo (Brazil) and its public policies. In order to understand the development of local capacity building in human rights we analyzed the main resources (normative, material, human and instrumental) of the Municipal Commission of Human Rights and the Municipal Secretariat of Human Rights and Citizenship, both organs of São Paulo, between 2002 and 2018. Thus, we can draw a narrative of the institutional history of human rights in the city of São Paulo, as well as concretize a critical analysis of discursive and communicational aspects that involve government management specialized in human rights. We rely on the Neo-Institutionalist theory, mainly in its historical and discursive currents, to approach the case study of such municipal public institutions, as this view treats institutions as relevant political actors for understanding society, as an intermediate scale between individuals and the State. The case study, in the end, demonstrates the challenge and at the same time the great importance of consolidating a public institution in the municipal government aimed at implementing human rights public policies. These are issues that are not being totally embodiment by the policies of other government agencies and require innovation for human rights to be a substantial part (what should be done, what right should be promoted) and procedural (how should it be done, what principles of human rights must be followed) of public policies. We hope thinking of this thesis will contribute to the various actors involved in the human rights agenda to be more to be more and more aware of the value of local contexts when establishing international human rights norms, so that they can be instruments for the development of the local institutional capacity for human rights promotion of human rights.
