Abstract: Esta dissertação pretende analisar a arbitragem de conflitos individuais de trabalho e a efetividade e eficácia do instituto. Partirá do conceito de conflito coletivo para classificá-lo em conflito individual ou coletivo, jurídico ou econômico. Serão analisados os meios extrajudiciais de resolução de conflitos: a conciliação, a mediação e arbitragem. A conciliação, também conhecida como negociação assistida, em razão de sua semelhança com os processos de negociação, pressupõe um terceiro, alheio ao conflito, que proporá conversações às partes, atuando como um facilitador. Na mediação, o terceiro adotará uma posição mais ativa e interventiva, não só indicando passos para a construção do consenso, mas também participando ativamente no conteúdo do objeto do consenso, diferenciando-se também pelo resultado. Por fim, a arbitragem é um processo decisório, em que um ou vários árbitros, de confiança das partes, produzirá uma sentença, de caráter vinculante e definitivo. Portanto, o protagonista é o árbitro. Quanto à arbitragem, será feito um balanço dos custos em comparação com os benefícios desta. Em razão de o direito do trabalho ser um ramo muito sensível, questionaremos se há confronto entre seus princípios e a arbitragem. A eficácia da decisão arbitral será questionada quando delimitada à esfera laboral. A arbitragem voluntária no direito laboral português será feita através de convenção de arbitragem em contrato individual de trabalho. Necessário, pois, analisar quais os critérios de arbitrabilidade dos litígios. Discorreremos sobre a convenção de arbitragem e os árbitros. Por fim, ampliaremos o âmbito de análise para outros países europeus, para verificar se o modelo português está em consonância com a experiência europeia e chegarmos a uma conclusão.
This study aims to analyze the arbitration of individual work conflicts and the effectiveness and efficiency of the institute. We will start with the concept of collective conflict to classify them in individual or collective, legal or economic. Alternative dispute resolution will be analyzed: conciliation, mediation and arbitration. Conciliation, also known as assisted negotiation, because of its similarity with negotiation processes, presupposes a third party, outside the conflict, who will propose chats to the parties, acting as a facilitator. In mediation, the third will adopt a more active and interventional position, not only indicating steps for the construction of consensus, but also actively participating in the content of the object of the consensus, also differentiating itself by the result. Finally, arbitration is a decision-making process, in which one or more arbitrators, trusted by the parties, will produce a binding and definitive ruling. Therefore, the protagonist is the referee. About arbitration, the cost will face the benefits and we will make a balance between them. Due to the sensitivity of the labor law, we will question whether there is a conflict between its principles and arbitration. The effectiveness of the arbitration’s decision will be questioned when delimited to the labor sphere. Voluntary arbitration in Portuguese labor law will be conducted through arbitration agreement in individual labor contract. Therefore, it is necessary to analyze the criteria for arbitrability of the dispute. We will discuss the arbitration agreement and the arbitrators.Finally, we will extend the scope of analysis to other European countries, to verify if the Portuguese model is in line with the European experience and, then, we can reach a conclusion.
