Abstract: De acordo com a doutrina, os estados detêm o poder soberano no que tange à determinação de quem são os seus nacionais e de quem perde a nacionalidade. Porém dos vários instrumentos de direito internacional de direitos humanos, bem como do direito europeu e do direito constitucional, assentes no reconhecimento dos direitos humanos, encontra-se consagrado o direito do indivíduo a uma nacionalidade.Os Estados estão vinculados a respeitar os direitos humanos do indivíduo em toda a sua atuação. No que tange a políticas de acolhimento de refugiados, requerentes de asilo, esta obrigação conduz à prática de políticas de controlo de migrações, que encontrem um equilíbrio entre os direitos e os deveres dos migrantes e que apliquem medidas de acolhimento e de integração duradouras, dando primacial importância às crianças carecidas de proteção internacional, primacialmente as que viajam desacompanhadas de qualquer adulto que lhes ofereça proteção. Devem ser tratadas como especialmente vulneráveis e têm direito a obter proteção face ao perigo que correm. Fogem de conflitos armados nos seus países de origem, de desastres naturais e de pobreza e, durante a travessia por rotas inseguras, foram vítimas de todos os tipos de violação dos seus direitos.O cumprimento dos direitos humanos exige, para a sua efetivação, a obtenção do estatuto legal de permanência, por parte do estrangeiro, em território nacional, principalmente no que tange a crianças e jovens, acolhidos em instituições do Estado ou equiparadas. O acesso destas crianças e destes jovens à naturalização do país onde se encontrem acolhidos constitui uma medida duradoura e estável de promoção e de proteção dos direitos da criança em perigo, a fim de evitar situações de apatridia.Por seu turno, as normas constitucionais consagradoras dos direitos das crianças e os instrumentos comunitários de proteção dos direitos humanos exigem a consagração da garantia a uma tutela segura e a um procedimento célere, que efetive esses direitos sem discriminação da raça, etnia, religião ou país do nascimento.O interesse superior da criança deverá ser tomado primacialmente em consideração por todas as entidades, em todas as decisões e ações que lhe digam respeito.
States are commonly assumed to hold sovereign power when it comes to determining who is a national and who loses nationality. However, the various instruments of international human rights law as well as European and constitutional law, based on the respect for human rights, recognise that each individual has the right to have a nationality.States are bound to respect the human rights of the individual in all their actions. In what concerns asylum-seeker refugee reception policies, this obligation leads to the practice of migration control policies which can not only strike a balance between the rights and duties of migrants, but also implement lasting reception and integration measures. In the process, special importance must be given to children requiring international support, primarily those travelling unaccompanied by any adult capable of proper care. These children should be treated as especially vulnerable and entitled to protection, given the situations of danger they have to endure. They are fleeing armed conflicts, natural disasters and poverty in their countries of origin and, while crossing unsafe routes, they have been victims of all kinds of violation of their rights.The fulfilment of human rights requires, for its realization, the acquisition of a legal status of permanence by the foreigner, in the national territory, mainly when it comes to children and youngsters hosted in state institutions or similar. The access of these children and youngsters to the naturalization in their host country is a lasting and stable measure for the promotion and protection of their rights when in danger, in order to avoid situations of statelessness.Furthermore, both the constitucional norms that enshrine the rights of the child and the communitarian instruments for the protection of human rights demand the guarantee of safe protection as well as fast procedures that will enforce those rights without discrimination of any kind, whether race, ethnicity, religion or country of birth. The best interest of the children should always be taken primarily into consideration by all entities in all decisions and actions concerning them.
