Análise ao artigo 567º/1 do CPC versus a finalidade processual de procura da verdade material

Abstract

O estudo consiste numa reflexão sobre o instituto da revelia normativamente consagrado nos artigos 566.º a 568.º do Código de Processo Civil, em particular o n.º 1 do artigo 567.º e anorma-estatuição de se considerarem por confessados e plenamente provados os factosarticulados pelo autor e não contestados pelo réu. Abordam-se os princípios do processo civilfundamentais à decisão-juízo e à justa composição do litígio. Analisam-se os efeitos da revelia:os que incidem sobre a marcha do processo; e essencialmente, os que afetam o julgamento dacausa. Dá-se a conhecer as linhas orientadoras dos sistemas doutrinários da ficta confessio e daficta litis contestatio. E no fim, avança-se para uma proposta no intento de aproximar a soluçãohoje vigente com os ditames da Verdade e da Justiça.

This thesis consists of a reflection on the default norm established in the articles 566º to 568ºof the Code of Civil Procedure; particularly in nº1 of the article 567º and the standard norm ofconsidering the facts articulated by the author and not disputed by the defendant, confessed andapproved. The essay approaches the principles of civil procedure, essential to judgment andfair composition of litigation. Furthermore, the effects of the default are analysed - namely theaffect in the progress of the trial and those that concern the judgment of the cause. Theguidelines of the doctrinal systems of ficta confessio and ficta litis contestatio are reviewed.Ultimately, a proposal is formulated in an attempt to bring closer together the solution now inrule and the guiding principles of Truth and Justice.
