O Poder Disciplinar Militar e a Relação Especial de Poder: o controle interno-explícito das forças de segurança de natureza militar luso-brasileiras

Abstract

A presente pesquisa concentra-se no controle exercido pelo poder disciplinar no âmbito interno das forças de segurança de natureza militar luso-brasileiras com o propósito de fortalecer a disciplina interna, sem contudo cometer abusos, reduzir os desvios de condutas dos seus integrantes, aperfeiçoar os procedimentos técnicos e táticos da instituição e garantir a melhoria da prestação do serviço aos cidadãos. Nas sociedades democráticas o controle das forças policiais é fundamental, tanto com o objetivo de impor limites legais a sua atuação, bem como para fiscalizar o efetivo cumprimento dos seus deveres e obrigações em conformidade com a lei e em benefício do interesse público. A escolha do tema se deu por três motivos: o primeiro diz respeito ao despertar das instituições militares para o exercício do poder disciplinar sobre a ótica corretiva-preventiva, e não apenas repressiva-punitiva. O segundo, pela necessidade de esclarecer que os militares são uma categoria de profissionais diferente das demais, submetidos a um estatuto especial e a um regime disciplinar mais severo, contudo, não renunciam ao exercício dos seus direitos fundamentais. E terceiro, pela escassez de pesquisas relacionadas ao controle interno, especialmente quanto aos órgãos centrais no âmbito das forças policiais de natureza militar e a desconfiança e o descrédito que, equivocadamente, se tem quanto a eles. Tem-se como objetivos apresentar os fundamentos do poder disciplinar atribuído à administração pública e como esse mesmo poder se dá nas instituições castrenses. Também exibir o poder disciplinar militar não apenas por meio do seu caráter repressivo-punitivo, mas, sob uma ótica pedagógica corretiva-preventiva. Além disso, explicitar o militar como um sujeito de direitos, embora suscetível a restrições. Ademais, pelo fato dos mecanismos de controle se tratar de uma temática que causa, em grande medida, antipatia, tanto por parte dos subordinados como pelos superiores hierárquicos, bem como, suspeitas por parte do cidadão, almeja-se desmistificar os seus propósitos e benefícios.

The present research concentrates on the control exercised by the disciplinary power within the Luso-Brazilian military security forces with the purpose of strengthening the internal discipline. However, maintaining the good conduct of its members, the technical and tactical procedures of the institution and guaranteeing the improvement of the provision of its services to the citizens should be achieved without committing abuses. In democratic societies the control of the police forces is fundamental, both to impose legal limits on their performance, as well as to oversee the effective fulfillment of their duties and obligations in accordance with the law and in the public interest. This topic was chosen for three reasons: the first concerns making military institutions aware of the need to exercise disciplinary measures from a corrective-preventive point of view rather than a merely repressive, punitive one. The second is the need to clarify that this military force is a category of professionals, different from others, and subject to a special statute and a stricter disciplinary regime, but this does not reduce the need to observe fundamental rights. And thirdly, there is a lack of research related to internal control, especially regarding the central agencies within the military police forces, and the mistrust and misrepresentation associated to them. This study presents the foundations of the disciplinary power attributed to public administration and how this same power functions in military institutions. It also analyses military disciplinary power not only through its repressive-punitive character, but also from a pedagogic, corrective-preventive approach. In addition, it makes explicit that the security forces have rights, although they are susceptible to restrictions. In addition, because control mechanisms are very unpopular on the part of the subordinates, as well as their hierarchical superiors and are viewed with suspicions by the public, it aims at demystifying their purposes and benefits.
