Abstract: A adoção destina-se a dar uma família a uma criança que dela carece, considerando que é melhor para a criança ser adotada do que viver em situações transitórias. Pretende-se com esse estudo, um esclarecimento maior relacionado ao modo com que os menores estão sendo tratados pelo Estado e pela sociedade, mostrar a devida importância que se deve dar ao futuro dessas crianças, que não possuem o privilégio de permanecer com suas famílias naturais, a possibilidade de serem adotadas por estrangeiros e o dever do Estado em proteger integralmente essa criança, visando sempre o melhor interesse dela, pois representa um bem maior para toda a sociedade. O objetivo do trabalho foi fazer um levantamento sobre adoção, buscando se conhecer seus tipos, embasamentos diferenciando a adoção nacional e a internacional. Pode-se perceber que a história da aceitação da adoção em Portugal é muito recente, devendo-se este prolongado repúdio em grande medida ao cunho iminentemente patrimonial que era dado ao instituto. A adoção internacional tem um regime jurídico específico, sendo necessário nesta a mudança do país de residência habitual da criança. A adoção internacional partilha com a adoção nacional grande parte dos seus efeitos. Contudo, pela natureza das situações internacionais, existem alguns efeitos que poderão ser gerados e que não encontram paralelo na adoção nacional, nomeadamente os relacionados com a nacionalidade do adotado.Adoção. Adoption is intended to give a family to a child who lacks it, considering that it is better for the child to be adopted than to live in transient situations. The purpose of this study is to clarify more about the way minors are being treated by the State and society, to show the importance that must be given to the future of these children who do not have the privilege of remaining with their natural families , the possibility of being adopted by foreigners and the State's duty to fully protect this child, always aiming at the best interests of the child, since it represents a greater good for the whole society. The objective of the study was to make a survey of the adoption, seeking to know its types, basics differentiating national and international adoption. It can be seen that the history of the acceptance of adoption in Portugal is very recent, and this long repudiation to a large extent was due to the imminently patrimonial character that was given to the institute. The international adoption has a specific legal regime, being necessary in this the change of the country of habitual residence of the child. International adoption shares a large part of its effects with national adoption. However, due to the nature of international situations, there are some effects that may be generated and that are not parallel in national adoption, especially those related to the nationality of the adoptee.Adoption.
