Saliente-se que as sociedades, através de um agressivo planeamento fiscal, tentam proceder a uma fuga fiscal de forma a maximizarem os lucros. Em contraponto, os estados adotam regimes que visam dificultar a elisão fiscal, sendo que a diversidade de regimes veio dar lugar a situações onde o combate à elisão fiscal levou a casos onde as pessoas coletivas são duplamente tributadas. A presente análise centra a sua atenção nas regras aplicáveis na União Europeia, a qual, que apesar da instituição de um mercado único e instituição de várias diretivas com vista a harmonização da legislação aplicável nos mais variados setores, ainda não conseguiu encontrar o caminho para a harmonização fiscal. Este processo é realizado através de acordos bilaterais entre os estados com vista à eliminação da dupla tributação, os quais normalmente assentam na Convenção Modelo da Organização para a Cooperação e Desenvolvimento Económico. No tratamento desta temática é de referir igualmente o trabalho da união no que toca à garantia das liberdades no espaço europeu, mais especificamente às liberdades de circulação, estabelecimento e prestação de serviços.O presente estudo visa observar as regras que os estados aplicam nas suas relações bilaterais de modo a conseguirem combater tanto a elisão fiscal como a dupla tributação e a influência que a União Europeia tem neste campo. The enormous diversity of tax systems that exist throughout the European area raises a number of problems when we are faced with the application of these systems in the societies, which cover the most varied forms. It should be noted that organizations, through aggressive tax planning, try to carry out a tax break in order to maximize profits. In other perspective, the states adopt regimes that aim at making tax avoidance harder, and the diversity of regimes has given rise to situations where the fight against tax avoidance has led to cases where legal persons are doubly taxed. The present analysis focuses on the rules applicable in the EU, which, despite the establishment of a single market and the establishment of several directives to harmonize the legislation applicable in a diversified range of sectors, they have not yet been able to find the way to tax harmonization. This process is carried out through bilateral agreements between states for the elimination of double taxation, which are usually based on the Model Convention of the Organization for Economic Co-operation and Development. In dealing with this problem, it is also worth mentioning the work of the Union in guaranteeing freedoms in the European area, more specifically the freedoms of movement, establishment and service provision.The present study aims to observe the rules that states apply in their bilateral relations in order to combat both tax avoidance and double taxation and the influence that the European Union has in this field. |
