Notas sobre a Representatividade Sindical em Portugal e no Brasil.

Abstract

This paper aims to analyze the representativity of the current portugueses and brazilian syndical organization. First, a research was done about the origin and construction of the syndical movement in an international scope, and its evolution in a national scope of the both countries. In this regard, an analyses of the syndical movement was done though an historic context, showing its importance for the achievement of labors right. Secondly, in order to entering the core of the object, it was sought to understand the notion of the institute of representativity, differentiating it from union representation, to verify its adoption or not by the Portuguese and Brazilian models of union organization and by the OIT. Later, the freedom of association was examined together with its dimensions as an assurance of the syndical autonomy and as men’s fundamental right, in order to discuss the applicability of representativeness in the models of plurality, unity and uniqueness and as a guarantee of the democratic state of law. Ahead we analyze different legal systems that adopt representativity in order to identify their various forms of measurement. In this context, we analyzed the Portuguese and Brazilian system of measurement of representativeness, at least, defending the need for adoption by Portuguese pluralism and the Brazilian uniqueness of criteria to measure representativity, as a way of guaranteeing the real and effective representation of workers. In summary, we propose a discussion about representativeness as a mechanism for strengthening and securing an effective Union action.

O presente trabalho apresenta uma breve análise da representatividade na atual organização sindical portuguesa e brasileira. Inicialmente, foi realizada pesquisa bibliográfica sobre a origem e a construção do movimento sindical no âmbito internacional, e sua evolução no âmbito nacional dos dois países. Nesse sentido, tem-se a análise do movimento sindical através do contexto histórico, demonstrando a importância da atuação sindical para consecução dos direitos trabalhistas. Em um segundo momento, para adentrar no cerne do objeto, procurou-se compreender a noção do instituto da representatividade, diferenciando-o da representação sindical, para assim verificar a sua adoção ou não pelos modelos português e brasileiro de organização sindical e pela própria OIT. Posteriormente, procedeu-se a análise da liberdade sindical e suas dimensões como garantia da autonomia dos sindicatos e como direito fundamental do homem, com a finalidade de debater a aplicabilidade da representatividade nos modelos de pluralidade, unidade e unicidade e como garantia do Estado Democrático de Direito. Adiante perquirimos diferentes ordenamentos jurídicos que adotam a representatividade com objetivo de identificar as suas diversas formas de aferição. Diante desse contexto analisamos o sistema português e brasileiro de aferição da representatividade, defendendo, por fim, a necessidade de adoção pelo pluralismo português e pela unicidade brasileira de critérios para aferição da representatividade, como forma de garantir a real e efetiva representação dos trabalhadores.Em síntese, propomos uma discussão sobre a representatividade como mecanismo de fortalecimento e segurança de uma efetiva ação sindical.
