Abstract: A presente análise busca ressaltar o debate sobre a importância da constitucionalização do direito do trabalho para o direito laboral atual. Para isso, inicia-se realçando as várias modalidades de constitucionalismo presente na construção das garantias do direito do trabalho, de forma a entender a evolução da constitucionalização trabalhista desde a ideia de um Estado ausente, até as tentantivas atuais de abrandar o protecionismo estatal. Ainda, para melhor compreensão dos ordenamentos juridicos portugueses e brasileiros, foi realizada uma breve análise dos princípios e garantias laborais estabelecidos pelo ordenamento constitucional de cada pátria, demonstrando os avanços e possíveis retrocessos ao longo de toda história de constitucionalização desta matéria. Nesta perspectiva, uma linha de evolução constitucional se forma, a fim de comprovar como as transformações políticas e sociais influenciaram nestas garantias constitucionais laborais.Evidente se faz a necessidade de demonstrar o Direito Laboral no tempo de crise e os caminhos buscados pelos sistemas juridico dos países em destaque para tentar coibir o desemprego e retomar o desenvolvimento da economia, de forma a demonstrar que, em que pese a grande importância do Direito do Trabalho, por si só, não deve ser considerado o fio condutor que impulsionou a crise econômica. As mudanças ocorridas no Direito Laboral por meio de flexibilizações que buscam a diminuição de custos na tentativa de abertura de mercado torna cada vez mais primordial o debate da preservação de direitos mínimos, principalmente os instituídos pela norma constitucional, como forma a combater abusos e evitar a precarização do trabalho. A presente análise, assim, propõe uma nova análise na constitucionalização de direitos trabalhistas, como a finalidade de uma proteção mínima e, por meio das garantias de autonomia das empresas e princípios de liberdade, atingir um equilíbrio entre a tutela do empregado e a evolução das empresas.
The present analysis seeks to emphasize the debate on the importance of the constitutionalization of labor law for the current labor law. For this, it begins by highlighting the various modalities of constitutionalism present in the construction of the guarantees of labor law, in order to understand the evolution of labor constitutionalization, from the idea of an absent state to the attempts current to slow down state protectionism.Also, for a better understanding of the Portuguese and Brazilian legal orders, it is necessary to make a brief analysis of the principles and guarantees established by the constitutional order of each homeland, throught the demonstration of the advances and possible setbacks throughout the entire history of constitutionalisation of this matter. In this perspective, a line of constitutional evolution is formed, in order to prove how the political and social transformations influenced these constitutional guarantees of labor.Evident is the need to demonstrate the labour law in the time of crisis and the paths sought by the legal systems of the countries highlighted to try to curb unemployment and resume the development of the economy. In order to demonstrate that, in spite of this, the great importance of labour law alone should not be regarded as the driver end that boosted the economic crisis.The changes in labor law through flexibility that seek to reduce costs in the attempt to open the market, make it increasingly paramount to debate the preservation of minimum rights, especially those instituted by the norm Constitutional law, as a way of combating abuses and avoiding the precarization of work.The present analysis thus proposes a new analysis on the constitutionalization of labor rights, such as the purpose of a minimum protection and, through the guarantees of corporate autonomy and principles of freedom, to strike a balance between the employee protection and the evolution of companies.
