CAMINHOS DA ANIMALIDADE: o Desenvolvimento da Consideração Ético-Jurídica de Todos os Animais

Abstract

O presente trabalho visa contribuir com o estudo dos Direitos (dos) Animais. Para tal, será discutida a consideração moral e jurídica atribuída aos animais não-humanos. Comumente considerados seres inferiores e irracionais, amplamente subservientes aos homens, animais não-humanos sofrem diversos tipos de exploração e maus tratos, permitidos pela ética e leis humanas. Através de uma análise teórico-filosófica, traçaremos o trajeto percorrido pela animalidade no âmbito ético-jurídico humano, contemplando as questões morais que envolvem o enquadramento dos não-humanos na comunidade moral, ultrapassando a visão antropocêntrica de que apenas os homens possuem valor e devem ser moralmente considerados. Será realizada uma ponderação acerca dos possíveis critérios adotados para o alargamento da comunidade moral, abordando brevemente correntes filosóficas que tratam do tema. Ainda, será debatido o status dos não-humanos na esfera jurídica e o seu local dentro dos ordenamentos jurídicos Brasileiro e Português. Por vezes considerados coisas, discorreremos sobre novas possibilidades de enquadramento destes dentro da comunidade jurídica, em categorias como tertium genus, entes personalizados ou entes despersonalizados. Por fim, refletiremos sobre um potencial futuro caminho a ser percorrido na defesa pelos animais, baseado na alteridade e no respeito pelas diversas formas de vida animal. Veremos que, para a ampliação da esfera ético-jurídica, é fundamental reconhecer a condição de Outro dos animais não-humanos, que são fins em si mesmos e detentores de capacidades e as consequentes necessidades, conforme sua natureza. A garantia de desenvolvimento de tais capacidades é essencial para todos os seres, vez que não basta limitarmo-nos à deveres negativos para com eles, evitando o seu sofrimento; devemos, também, lhes oportunizar florescer.

The present work intends to contribute to the study of Animal Rights. To this end, the moral and legal consideration attributed to nonhuman animals will be discussed. Commonly considered inferior and irrational beings, widely subservient to men, nonhuman animals suffer from various types of exploitation and ill-treatment, permitted by human ethics and laws. Through a theoretical-philosophical analysis, we will trace the path traveled by animality in the human’s ethical-legal framework, contemplating the moral issues that surround the framing of nonhumans in the moral community, surpassing the anthropocentric view that only men have value and must be morally considered. We will consider the possible criteria to be adopted for the expansion of the moral community, briefly discussing philosophical approaches that deal with the subject. Moreover, the status of nonhumans in the legal sphere and their place within Brazilian and Portuguese legal systems will be debated. Often considered things, new framing possibilities for them within the legal community, in categories such as tertium genus, personalized and depersonalized entities, will be discussed. Finally, we will reflect on a potential future path to be followed in the defense of animals, based on alterity and respect for the various forms of animal life. We will see that, in order to expand the ethical-juridical sphere, it is fundamental to recognize the condition of Other of nonhuman animals, which are ends in themselves and holders of capacities and the consequent necessities, according to their nature. Guaranteeing the development of such capacities is essential for all beings, since it is not enough to limit ourselves to our negative duties towards them, trying to avoid their suffering; we should also give them the opportunity to flourish.
