dc.description.abstract | Sob uma perspectiva dogmática e utilizando um referencial legislativo e bibliográfico, a presente dissertação busca analisar os contornos e as especificidades das regulamentações do instituto da Mediação na Justiça Civil brasileira, italiana e portuguesa. Partindo de três opções legislativas completamente distintas, expôs-se em quais pontos os ordenamentos processuais se distanciam e em quais se aproximam, bem como os motivos sócio-políticos que fizeram com que cada país a incorporasse de forma como fizeram. A partir dos estudos de tais experiências, das suas vantagens e desvantagens, bem como as consequências de cada opção, é traçado um perfil a ser seguido como ideal para uma futura regulamentação definitiva da matéria. Não obstante, o estudo se inicia com uma análise dos propósitos da disciplina do direito processual civil, da concepção doutrinária sobre o tema, visando demonstrar a pertinência da opção por outros métodos de solução de conflitos que não a judicatura contenciosa estatal, independente da teoria que se adote. De tal sorte, demonstra-se que o fato do Estado ser o detentor do monopólio da prestação jurisdicional não é fator impeditivo para que possa oferecer outras opções de solução de conflitos, nomeadamente a Mediação, no real sentido de um Tribunal Multiportas, os quais igualmente podem contribuir para uma melhor e mais efetiva tutela jurisdicional, cujos reflexos serão observados não somente no âmbito da administração da justiça civil, mas na pacificação social. | por |
dc.description.abstract | From a dogmatic perspective and using a legislative and bibliographical referential, this dissertation seeks to analyze the specificities of the Mediation regulation in the Brazilian, Italian and Portuguese Civil Justice systems. Starting from three completely different legislative options, it was exposed in which points the procedural orders distance themselves and in which they approach, as well as the socio-political reasons that made each country incorporate it as they did. From the studies of such experiences, their advantages and disadvantages, as well as the consequences of each option, it is intended to draw a profile to be followed, considering it as an ideal and definitive model for future regulations of this subject. Nevertheless, the present dissertation begins with an analysis of the purposes of the procedural law discipline, of the doctrinal conception on the subject, in order to demonstrate the pertinence of the option for other methods of conflict resolution, other than the state contentious judiciary, independent of the theory adopted. Thus, it is demonstrated that the fact that the State is the holder of the monopoly of the jurisdiction provision is not factor preventing it from offering other options for resolving conflicts, namely Mediation, in the real sense of a Multidoor Courthouse, which can also contribute to a better and more effective protection which will be reflected not only in the administration of civil justice, but also in the social pacification | eng |
