The present work has as proposal to present the criminal abolitionism, the penal minimalism and the restorative justice. we will seek to understand what is wrong with criminal law, against the punitive power of states and their effective application. We will analyze the abolitionist, minimalist currents and means of restorative justice in search of reasons that justify or not the need for a strong and repressive criminal law.In the case of criminal abolitionism, this theory is derived from critical criminology, the present work will confine itself to showing the views of criminologists Louk Hulsman and Nils Christie, analyzing the understanding of the meaninglessness of criminal law.In the area of penal minimalism, we will try to talk about the theories presented by jurists Alessandro Baratta and Luigi Ferrajoli, understanding how the authors seek to legitimize Criminal Law differently from the abolitionist perspective. Dismantling the vision of criminal law in a way that legitimates the rule of law. In addition, as a way of increasing the study, brief considerations will be made on restorative justice, thus analyzing a counterpoint or a middle ground between the two lines of thought. The first chapter proposes a historical evolution regarding the penal system, the penalty and the evolution of the prison sentence, as well as the criminological movements that collaborated to maintain a punitive system; The second chapter deals with criminal abolitionism in order to present its concept, objective, evolution, as well as abolitionism in the view of Louk Hulsman and Nils Christie; The third presents the minimalist models of Alessandro Baratta and Luigi Ferrajoli, as mentioned previously and in the fourth and last chapter, to conclude, we will make brief considerations about restorative justice, in an attempt to present a link between the abolitionist and minimalist proposals.
