A violência doméstica contra a mulher no âmbito conjugal e a justiça restaurativa: a mediação penal como alternativa a solução dos conflitos de violência doméstica.

Abstract

Este trabalho tratará da violência doméstica contra a mulher no âmbito conjugal e a resolução dos conflitos por meio da justiça restaurativa, mais precisamente, a mediação penal. Tratar-se-á no primeiro capítulo acerca das considerações iniciais acerca da violência doméstica, onde será demonstrado ser um assunto antigo e que ainda nos dias de hoje se mantém presente na comunidade em geral. De igual modo, no segundo e terceiro capítulo será tratado dos conceitos e tipos de violência doméstica das alterações da natureza do crime de violência doméstica. Isto, para que seja possível no quarto capítulo, compreender a evolução do crime de maus tratos e a nova tipificação, passando a análise da natureza deste crime (dentre público, semi-público e novamente público), bem como da suspensão provisória do processo no crime de violência doméstica, comentando acerca da “válvula de escape do sistema” trazida por esta figura de suspensão como modo de demonstrar a manifestação livre e esclarecida da vítima.Após isto, para chegar a um entendimento, de entre outros materiais, serão analisados os Relatórios Anuais de Segurança Interna dos anos de 2008 até 2018, os quais serão comentados pelo desenvolvimento do crime de violência doméstica e as medidas de prevenção aplicadas nos respectivos anos. Passando-se assim, para o questionamento do direito penal ser o meio mais eficaz para eliminar a violência doméstica. Por fim, consoante estas análises, será demonstrado e analisado o conceito da justiça restaurativa desde a sua origem. Além disso, será estudada a opinião de autores acerca deste tema, assim como também a especificação da mediação penal ao tratar da mesma no crime de violência doméstica no âmbito conjugal e a sua possível aplicação, sendo este o tema principal deste trabalho.

This work will deal with domestic violence against women in the marital context and the resolution of conflicts through restorative justice, more precisely, criminal mediation. It will be discussed in the first chapter on the initial considerations about domestic violence, where it will be shown to be an old issue and still present today in the community at large.Likewise, in the second and third chapters we will discuss the concepts and types of domestic violence of changes in the nature of the crime of domestic violence. This, in order to be possible in the fourth chapter, to understand the evolution of the crime of ill-treatment and the new classification, passing the analysis of the nature of this crime (public, semi-public and again public), as well as the provisional suspension of the process in the crime of domestic violence, commenting on the "escape valve of the system" brought by this figure of suspension as a way to demonstrate the free and enlightened manifestation of the victim.After this, to reach an understanding, among other materials, the Annual Internal Security Reports from 2008 to 2018 will be analyzed, which will be commented on by the development of the crime of domestic violence and the prevention measures applied in the respective years. Thus, the questioning of criminal law is the most effective way to eliminate domestic violence.Finally, according to these analyzes, the concept of restorative justice will be demonstrated and analyzed from its origin. In addition, the authors' opinion on this topic will be studied, as well as the criminalization of criminal mediation in the treatment of domestic violence in the conjugal sphere and its possible application, which is the main theme of this work.
