dc.description.abstractO tempo de trabalho ocupa um lugar central na relação de trabalho, constituindo um dos terrenos em que os interesses contrapostos das partes colidem com maior grau de pressão, levando a instituição de uma organização jurídica, que implicou na separação de um tempo de trabalho, produtivo e homogêneo, compreendido dentro de um espaço delimitado e que constituiria o limite da heterodisponibilidade e um tempo residual, denominado livre ou de não trabalho. No entanto, nas últimas décadas, diversas transformações impactaram significativamente o tempo de trabalho, implicando, em uma flexibilização, heterogeneização e na invasão, no tempo livre, pelo tempo subordinado, rompendo as “fronteiras” entre trabalho e não trabalho, afetando o equilíbrio entre as diversas esferas da vida social e da relação jurídica de trabalho. Essa realidade de tempos mais densos, intensos, caracterizados por uma disponibilidade permanente tem levado a suscitar um “direito” à desconexão do trabalho, no entanto, haveria esse direito? Em caso positivo, quais seriam seus delineamentos e como conformá-lo juridicamente reconstruindo uma adequada disponibilidade ou uma “nova fronteira”? Como tornar efetivo esse “direito”? É nessa linha que se propõe essa dissertação. A partir de uma análise preponderantemente dogmática, sob o viés da desconexão, serão contextualizados os principais problemas, que têm implicado em uma transformação dos tempos de trabalho/não trabalho nos ordenamentos jurídicos português, espanhol, italiano, francês e brasileiro, sob a influência da flexibilização e das TICs, bem como, serão abordados os impactos advindos dessas transformações especificamente no equilíbrio vida-trabalho, na privacidade, saúde e segurança do trabalhador. O tipo de investigação utilizada para o desenvolvimento do trabalho pautou-se na pesquisa bibliográfica feita a partir de referências teóricas publicadas.por
dc.description.abstractThe working time occupies a central place in the working relationship, constituting one of the lands in which the contracting interests of the parties collide with a greater degree of pressure, leading to the establishment of a legal organization, which implied the separation of A working time, productive and homogeneous, understood within a delimited space and that would constitute the limit of legal subordination and a residual time, denominated free or not work. However, in the last decades, several transformations have significantly impacted the working time, implying, in a flexible, heterogenization and in the invasion, in the free time, by the subordinate time, breaking the "boundaries" between work and not work, affecting the balance between the various spheres of social life and the juridical work relationship. This reality of more dense, intense times, characterized by permanent availability has led to a “right” to disconnection from work, however, would there be this right? If so, what would be their designs and how to legally conformity it by rebuilding an adequate availability or a "new frontier"? How to make this "right" effective? This is the line that proposes this dissertation. From a preponderantly dogmatic analysis, under the bias of disconnection, the main problems will be contextualized, which have implicated in a transformation of working/non-working times in the Portuguese, Spanish, legal, Italian, French and Brazilian, under the influence of flexibilization and ICTs, as well as, will be approached the impacts arising from these transformations specifically in the life-work balance, in the privacy, health and safety of the worker.
