dc.description.abstract | O objetivo geral do presente é desenvolver o instrumento da tutela antecipada, com passagem pelas demais tutelas provisórias, para então verificar sua possibilidade de se estabelecer como remédio processual frente as dificuldades temporais encontradas no processo civil brasileiro. Para chegarmos à conclusão foi preciso uma abordagem nos instrumentos constitucionais que iluminam o processo civil brasileiro, abarcando uma diferenciação entre regras e princípios com a adoção de um dos modelos teóricos como norte para este estudo e ainda a diferenciação sistemática da natureza jurídica de processo e procedimento para uma fundamental compreensão do atual modelo adotado pela processualística brasileira. O estudo delimitou-se entre a promulgação do Código de Processo Civil de 1973 até os dias de hoje, com a vigência do Código de Processo Civil promulgado em 2015. A fundamentação teórica se sustenta pela legislação e pelos principais doutrinadores brasileiros com uma breve exposição estrangeira da visão italiana, alemã e portuguesa da aplicação dos instrumentos antecipatórios. Também foram utilizadas jurisprudências como métodos exemplificativos para uma aproximação com o empirismo jurídico. A metodologia científica utilizada foi uma pesquisa explicativa com base nas diversas fontes encontradas (livros, manuais, artigos de revista etc). A conclusão deste trabalho após avaliação dos métodos apresentados foi a conclusão da tutela antecipada como remédio processual frente sua eficácia na justiça brasileira. | por |
dc.description.abstract | The general objective of the present is to develop the instrument of early guardianship, with passage through the other temporary guardians, to then verify its possibility of establishing itself as a procedural remedy against the temporal difficulties encountered in the Brazilian civil process. In order to reach the conclusion, an approach was necessary in the constitutional instruments that illuminate the Brazilian civil process, including a differentiation between rules and principles with the adoption of one of the theoretical models as north for this study and also the systematic differentiation of the legal nature of process and procedure for a fundamental understanding of the current model adopted by Brazilian proceduralists. The study was delimited between the promulgation of the Code of Civil Procedure from 1973 to the present, with the validity of the Code of Civil Procedure promulgated in 2015. The theoretical basis is supported by legislation and the main Brazilian doctrinators with a brief foreign exposure of the Italian, German and Portuguese view of the application of the anticipatory instruments. Jurisprudences have also been used as exemplary methods for an approximation with legal empiricism. The scientific methodology used was an explanatory research based on the different sources found (books, manuals, magazine articles etc). The conclusion of this work after evaluation of the methods presented was the conclusion of the early protection as a procedural remedy against its effectiveness in the Brazilian justice system. | eng |
