A Responsabilidade Civil dos Clubes em caso de Lesões dos Desportistas

Abstract

A presente dissertação integra a fase final do Mestrado em Ciências Jurídico-Civilísticas, com Menção em Direito Civil, realizado na Faculdade de Direito da Universidade de Coimbra, e tem como objectivo o estudo do direito relacionado com a área desportiva, nomeadamente no que diz respeito ao problema das lesões, tanto sofridas por atletas profissionais, como por crianças e jovens, e da responsabilidade que por elas possa avultar. Dada a cada vez maior profissionalização do desporto, urge perceber qual o papel dos clubes nesta matéria, isto é, qual a sua responsabilidade em caso de surgimento de lesões e no tratamento das mesmas. Trata-se de um problema transversal a todo o fenómeno desportivo, pelo que é necessário compreender qual o impacto que a acção dos profissionais dos clubes onde actuam os desportistas pode ter e em que medida sobre eles incide ou não um dever de prevenir e debelar as respectivas lesões da melhor forma. Para cumprirmos o nosso desiderato, é fundamental ter presente os tipos contratuais associados à área desportiva, nomeadamente o contrato de trabalho desportivo e o contrato de formação desportiva, sendo que existem ainda casos em que não existe qualquer contrato em causa e que necessitam igualmente de ponderação. Neste sentido, ganha também importância a figura dos seguros desportivos. Por fim, convém ainda distinguir entre clube e sociedade anónima desportiva, sobretudo devido à responsabilidade que recai sobre a sociedade pelos actos dos seus funcionários, sendo ainda necessário abordar a temática da organização de eventos desportivos, na medida em que a segurança dos espectadores e dos atletas em relação a danos que aqueles venham a provocar é crucial.

The current dissertation is a part of the final stage of the Masters’ Degree in Civil Law, in Coimbra Law School. Its main goal is the study of a branch of the law related with the sports, in particular with regard to the problem of injuries, both suffered by professional athletes, children and young people, and with regard with the liability of teams and other professionals. Given the increasing professionalism of sport, it is urgent to understand the role of teams in this area, that is, their liability for injuries in case of sport events and treatments. This problem is transversal to the whole sports phenomenon and therefore it urges to understand the impact of negligence of the professionals acting in the teams where the sportsmen act and to what extent they have a duty to prevent and treat the injuries that may occur.In order to achieve the main goal of our work, we must take in consideration the types of contracts that may be associated with sports, namely the working sports contract and the training sports contract, as well as the hypothesis in which there is no contract at all. In the context of the dissertation, the figure of sports insurance also becomes important.Furthermore, we also need to make a distinction between private and public liability of the sports companies, mainly because of the liability of corporates for the acts of its employees, as well as question the problems connected with the organization of sport events, for instance the safety of spectators and athletes in relation to the damages that those spectators may cause.
