Abstract: O tema apresentado nesta dissertação tem por base um trabalho de análise às cláusulas contratuais gerais. Numa primeira fase irei debruçar-me sobre as questões relativas à natureza jurídica e a origem e evolução deste instituto. Posteriormente passarei ao Regime Jurídico das Cláusulas Contratuais Gerais, – RJCCG, estabelecido pelo Decreto Lei 446/85 de 25 de outubro, pautado no reconhecimento dos potenciais prejuízos decorrentes dos abusos cometidos e passou a disciplinar os parâmetros de limitação da liberdade contratual, de forma a estabelecer uma nova arquitetura do modelo regulamentação dos contratos, focada na garantia da igualdade das partes.A adoção de cláusulas previamente elaboradas, a partir de modelos e padrões contratuais é uma manifestação jurídica da sociedade moderna, baseada em trocas económicas, que pode ser observada nos mais diversos sectores do mercado e nos mais variados tipos de contratação.Cumpre verificar quais os meios utilizados para o controle das cláusulas contratuais gerais e de que forma pode o aderente reagir quando verificar uma cláusula contratual geral abusiva. Pretende-se compreender qual o papel do aderente na iniciativa processual e quais os meios que dispõe para se proteger de eventuais cláusulas proibidas.Dito isto, analisar-se-ão situações jurídicas de vulnerabilidade de há muito conhecidas e estabelecidas, como a situação do consumidor e em que medida deve ser efetuada o controle das cláusulas contratuais gerais nos contratos que o envolvam, mas também e talvez principalmente situações novas em que a parte mais fraca não era assim considerada até bem pouco tempo e, portanto, não recebia a justa proteção que o direito deveria dedicar-lhe.
The theme presented in this dissertation is based on an analysis of the general contractual clauses. As a first step, I will look at issues relating to the legal nature and origin and evolution of this institute. Subsequently, I will go to the Legal Regime of the General Contractual Clauses, - RJCCG, established by Decree Law 446/85 of October 25, based on the recognition of potential losses resulting from the abuses committed and began to discipline the parameters of limitation of contractual freedom, in order to establish a new architecture of the contract regulation model, focused on ensuring the equality of the parties.The adoption of previously elaborated clauses, based on contractual models and standards, is a legal manifestation of modern society based on economic exchanges, which can be observed in the most diverse sectors of the market and in the most varied types of contracting.It is necessary to verify the means used to control general contractual clauses and how the member can react when he finds an abusive general contractual clause. It is intended to understand the role of the adherent in the procedural initiative and what means he has to protect himself from any prohibited clauses.That said, we will analyze legal situations of vulnerability that have long been known and established, such as the situation of the consumer and to what extent control of the general contractual clauses in the contracts that involve it, but also and perhaps mainly new situations in which the weaker party was not considered until very recently and therefore did not receive the just protection that the law should devote to it.
