Acontece que o Código de Processo Civil não dá nenhuma resposta a este problema, deixando-o desregulamentado, por conseguinte, fica a solução, a cargo da doutrina e da jurisprudência. Contudo, existe entre elas e mesmo dentro delas uma disparidade de opiniões quanto à solução que devemos adotar, pelo que, não existe uma solução unânime de resolução do problema.Podemos dizer, em termos gerais, que a prova ilícita é uma prova que viola disposições do ordenamento jurídico, assim sendo, relaciona-se de forma íntima com o direito fundamental do direito à prova. Isto porque, ao não se admitir a prova ilícita estar-se-á a limitar o direito à prova das partes, que ainda que possa ser limitado, tal limitação tem de ser devidamente fundamentada.No Processo Penal a prova ilícita é regulada expressamente e considerada como inadmissível pelo art.32º/8 da CRP e, uma grande parte da doutrina portuguesa com base nesse regime, defende a inadmissibilidade das provas ilícitas também no processo civil, por via da aplicação analógica desse mesmo artigo e, portanto, da solução dada a essas provas no âmbito do Processo Penal. Da mesma forma, alguma jurisprudência vê nessa aplicação a solução correta a esta problemática. É necessária a realização de uma análise, não só a esta solução, como também às restantes teses que tentam resolver esta questão, nomeadamente a liberal, restritiva e intermédia, e os argumentos por elas utilizados.Assim sendo, com este estudo pretendemos demonstrar que a solução mais adequada e que melhor resolverá a admissibilidade das provas ilícitas no âmbito do processo civil, vai de encontro às finalidades do mesmo, concretamente, a procura da verdade material e do alcance da justa composição do litígio, sendo a mais equilibrada, a que é ponderada caso a caso, fundamentando-se através de uma ideia de proporcionalidade. The study discussed and developed in this thesis deals with the admissibility of illegal evidence in civil procedure, in the Portuguese legal system. It turns out that the Civil Procedure Code does not provide any answer to this problem, leaving it deregulated, and therefore, the solution stays in charge of the doctrine and jurisprudence. However, between them, and even within each one, there are a diversity of opinions as to what solution should be adopted, so there is not an unanimous solution to solve the problem.We can say, broadly speaking, that the illegal evidence is the evidence that violates provisions of the legal order, and thus, it is intimately related with the right to proof, which is a fundamental right. Because, by not admitting the illegal evidence, we would be limiting the parties’ right to proof, that even though, it can be limited, such limitation must be duly substantiated.In Criminal proceedings the illegal evidence is expressly regulated and considered as inadmissible by article 32º/ 8 of the CRP, and there is a large part of the Portuguese doctrine that, based on that regime, defends the inadmissibility of illegal evidence also on civil procedure, through analogical application of that same article and, consequently, of the same solution given to those evidences in the criminal procedure. In the same way, some jurisprudence sees in this application the correct solution to this problem. It is necessary to carry out an analysis, not only on this solution, but also, on the other theses that attempt to solve this issue, namely the liberal, restrictive and intermediate, together with their respective arguments.Therefore, with this study, we intend to demonstrate that the most appropriate solution and that best resolves the admissibility of illegal evidence in the civil procedure, will meet the aims of that same process, namely the pursuit of the truth and the reach of a fair composition of the litigation, being the most balanced, which is considered, case by case, and based on the idea of proportionality. |
