Em termos jurídico-processuais, os tribunais portugueses recorriam, de forma desmesurada, à interdição, desatendendo à concreta e real situação do interditando, ou seja, aplicavam descuradamente uma medida de total substituição da vontade e dos desejos do visado. A presente reforma legislativa adaptou harmoniosamente o sistema nacional aos princípios decorrentes da Convenção de Nova Iorque sobre os direitos das pessoas com deficiência, em vigor em Portugal desde 2009. Deste modo, elimina os anteriores instrumentos de interdição e inabilitação, para passar a prever uma solução monista de acompanhamento de maiores, inspirada no modelo alemão. Atualmente, a ação do maior acompanhado é regulada por algumas das disposições que regem os processos de jurisdição voluntária, e a grande novidade do regime é a concessão de legitimidade ativa ao maior para este iniciar o processo, ampliando assim a sua autonomia e a autodeterminação. O novo rito processual da ação especial de acompanhamento de maior terá como intuito proporcionar ao maior uma resposta justa, adequada e eficaz. No entanto, para se atingir este propósito, cumprindo ao máximo os desejos e vontades do maior, o juiz deve dirigir ativamente o processo, interessar-se e envolver-se na procura dessa resposta individualizada. Previously, the regime of the incapacities of the person’s full age was composed by the full and partial guardianship, rigid and inflexible solutions, aimed, above all, to protect patrimonial interests of the person’s full age and their families. In procedural terms, the Portuguese courts relied inordinately on the institution of the interdiction or full guardianship, neglecting the concrete and real situation of the person; in other words, they applied a measure of total substitution of the will and desires of the beneficiary. This legislative reform has harmoniously adapted the national system to the principles arising from the New York Convention on the Rights of Persons with Disabilities, which has been in force in Portugal since 2009. It eliminates the previous instruments of full and partial guardianship, in order to provide only one solution called adult accompanied, or legal custodianship, inspired by the German solution. Currently, the action of the major accompanied is regulated by some of the voluntary jurisdiction proceedings, and the great innovation of this regime is the granting of the legitimacy to the adult to initiate the process, extending its autonomy and self-determination. The new procedural rite of this special action seeks to ensure a fair, adequate and effective response. However, in order to achieve this purpose and to fulfil the desires and best wishes of the person’s full age, the judge must actively lead the process, be interested and be involved in the search for this individualized response. |
