dc.description.abstract | Esta pesquisa trata das espécies do instituto premial nos ordenamentos jurídicos de Portugal e do Brasil e a (im)prescindibilidade de sua utilização no crime de corrupção. Ao realizar um estudo cronológico breve sobre o “nascimento” até a utilização do modelo premial no sistema da civil law, este trabalho tenta, de forma objetiva, demonstrar a inspiração das autoridades brasileiras na utilização da colaboração premiada, bem como aponta as críticas positivas e negativas sofridas pelo modelo. Através dos vários posicionamentos trazidos nesta pesquisa será possível observar as vantagens e desvantangens na aplicação de um método de investigação que, por vezes, esbarra em questões principiológicas que podem ferir direitos e garantias fundamentais de co-arguidos em prol das concessões de benefícios a ex-comparsas arrependidos.Esta pesquisa trata das espécies do instituto premial nos ordenamentos jurídicos de Portugal e do Brasil e a (im)prescindibilidade de sua utilização no crime de corrupção. dc.description.abstract | This research deals with the species of the premier institute in the legal systems of Portugal and Brazil and the (in)dispensability of its use in the crime of corruption. By carrying out a brief chronological study on source to the use of the premier model in the civil law system, this work attempts, in an objective way, to demonstrate the inspiration of the Brazilian authorities in the use of the awarded collaboration, as well as to point out the positive and negative criticisms suffered by the model.
