O início da tentativa nos casos de autoria mediata

Abstract

A presente investigação concentra-se na temática do início da tentativa nos casos de autoria mediata e qual deve ser a posição a adotar neste complexo problema. Pretendemos fazer uma análise do problema em questão e estudar as soluções que são propostas pelos diversos autores. Faremos uma análise das teorias propostas enaltecendo os seus méritos e as suas falhas, de forma a poderemos chegar a uma resposta à questão: quando tem início a tentativa do autor mediato (aquele sujeito que executa o facto através de outrem). Sendo o tema bastante discutido na doutrina e jurisprudência, tanto portuguesa como estrangeira, procederemos a uma análise crítica das diversas soluções propostas que pretendem dar resposta à seguinte questão: quando é que se pode considerar iniciada a tentativa do autor mediato ? Serão analisadas com mais intensidade as três teorias mais relevantes: a solução puramente individual, a solução individual modificada e a solução global ou conjuntaEsta análise será feita com recurso a algumas hipóteses práticas, uma vez que a análise da questão é facilitada pelo uso de casos que nos permitam ver o porquê desta questão ser tão complexa.Começaremos por fazer uma breve introdução dos conceitos de autoria (prevista no art.26º do CP) e tentativa (regulada no art.21º e seguintes do CP), ambos imprescindíveis para que se possa fazer uma análise do tema em questãoSendo esta questão muito discutida na doutrina, pretende-se chegar a uma solução satisfatória que respeite a legislação do nosso ordenamento jurídico.

The present investigation focuses on the thematic of the beginning of the attempt in cases of mediate authorship and what should be the position to adopt in this complex problem. We intend to make an analysis of the problem in question and study the solutions that are proposed by the diferent authors. We will make an analysis of the proposed theories extolling their merits and their failures with the objective of finding the answer to the question: when begins the attempt of the mediate author (that person who executes the fact through another)?As the topic is very much discussed in Portuguese and foreign doctrine and jurisprudence, we will proceed to a critical analysis of the various solutions proposed that intend to answer the following question: when can the mediate attempt be considered initiated? The three most relevant theories will be analyzed more intensely: the purely individual solution, the modified individual solution, and the global or joint solution.This analysis will be made using some practical hypotheses, since the analysis of the question is facilitated by the use of cases that allow us to see why this question is so complex.We will start with a brief introduction of the concepts of authorship (foreseen in art. 26 of the Portuguese Criminal Code) and attempt (regulated in art.21 and following of the Portuguese Criminal Code), both essential for an analysis of the subject in question.As this issue is very discussed in the doctrine, we intend to find a satisfactory solution that respects the legislation of our legal order.
