Abstract: RESUMOIntrodução: Trata-se do estudo da justiça e da teoria kelsenianas, iniciam-se no contexto da moralidade e vai ao positivismo jurídico. À primeira vista excludentes, mas que, numa visão mais aprofundada mostram-se complementares, já numa condição de pensamento e aplicação. Uma comparação breve entre a Teoria Pura do Direito de Kelsen e a Regra de Reconhecimento de Hart serão abordadas. Objetivo: O presente trabalho busca aprofundar o conhecimento relativo aos ensinamentos de Kelsen acerca da justiça, tema que Kelsen abordou em várias obras, e que apresentou relevantes questionamentos sobre seus fundamentos; e, sobre a Teoria Pura do Direito e sua Norma Fundamental, a Grundnorm, a teoria kelseniana, que ao surgir, alterou a forma de pensamento sobre o Direito no século XX, centrada na transição do direito natural para o direito positivo, mais precisamente, do direito como moral (justo), para o direito como ciência. Inseridas nesta transição jurídica estão as teorias de Kelsen e Hart, das quais busca-se a compreensão de seus distanciamentos e aproximações. Método: Este estudo concentra-se em pesquisa realizada através de consulta bibliográfica, à obra de Kelsen referentes aos temas deste trabalho e a obras de autores que tratam dos mesmos temas e a estes são correlatos. Resultado: A pesquisa bibliográfica nos trouxe o conhecimento fundado de que, o instituto da justiça, é mutável e adequa-se (molda-se) aos conceitos de determinado grupo de pessoal e em determinado tempo, portanto, compõe-se de conceitos que vão, no ritmo da evolução dos conceitos humanos coletivos, alterando-se. Quanto aos efeitos da teoria kelseniana sobre o pensamento jurídico, após a publicação da Teoria Pura do Direito, não ficaram despercebidos, provocando manifestações de apreço de juristas que compreendem o ordenamento jurídico consubstanciado no direito positivo, como, também, críticas intensas dos juristas compreendidos num viés de justiça natural, críticos ao distanciamento do direito positivo das normas de conduta moral. Conclusão: Dentro da vasta obra de Kelsen, duas questões estiveram em constante evidência, a primeira é a questão da justiça, questionada em seus efeitos e alternâncias dentro do Direito; e, a segunda questão foi a busca por um Direito como ciência jurídica, afastando-se de toda matéria que não fosse exclusivamente de direito, como a Sociologia, a Política etc, objetivo conquistado por Kelsen de forma brilhante, alterando definitivamente o ponto de vista dos afetos ao estudo do Direito.
ABSTRACTIntroduction: The principle of justice and the Kelsenian theory, begins in the context of morality and legal positivism. At first glance they are excludable, but in a deeper vision, it shows a kind of thought and application. A brief comparison between Kelsen's Pure Theory of Right and Hart's Rule of Recognition will be addressed. Objective: The present work will be deepen the knowledge about Kelsen's teachings regarding justice, were Kelsen addressed in several works, and which presented relevant questions about its foundations; and, on the Pure Theory of Law and its Fundamental Rule, the Grundnorm, the Kelsenian theory, when it emerged, modified the way of thinking about Law in the twentieth century, focused on the transition from natural law to positive law, more precisely, law as moral (right), to the right as science. Inserted in the legal transition, appeared the theories of Kelsen and Hart, the search for the understanding of their distances and approximations. Method: This study focuses on research carried out through bibliographic search related to the work of Kelsen associated to the themes of this work and similar authors dealing with the same themes and to these are correlates. Result: Bibliographical research has brought us the grounded knowledge that the institute of justice is changeable and adapts (molds itself) to the concepts of a particular group of personnel and in a given time will be composed of concepts that evolution of collective human concepts, altering itself. As for the effects of the Kelsenian theory on juridical thinking after the publication of the Pure Theory of Law, it did not go unnoticed, provoking manifestations of appreciation by jurists who understand the legal order embodied in positive law, as well as jurists intense criticism comprised in a bias of natural justice, critics of distancing from the positive law of norms of moral conduct. Conclusion: Inside Kelsen's vast work, two questions have been in constant evidence; the first is the question of justice, questioned in its effects and alternations within the law; and the second question was the search of a Right as a legal science, moving away from any matter that was not exclusively of Right, such as Sociology, Politics, etc., a goal achievements by Kelsen in a brilliant way, definitively altering the point of view to the study of right.
