dc.description.abstract | O instituto jurídico “abuso do direito processual” destina-se a repelir comportamentos desleais e contrários à boa-fé. O tema, amplamente consolidado no Direito Civil, ainda é pouco debatido pela doutrina processualista e de tímida aplicação prática pela jurisprudência. Todavia, o cotidiano demonstra que, a cada dia, os litigantes inovam na utilização de expedientes que contrariam a finalidade precípua do ato processual, almejando objetivo diverso. Diante deste quadro, daremos enfoque ao fenômeno da multiplicação de demandas, tanto decorrente do fracionamento do seu objeto, como do fracionamento do seu polo ativo ou passivo. A partir dessa análise, veremos se existe uma relação intrínseca entre o interesse de agir e o abuso do direito processual, de modo que o dito pressuposto possa ser utilizado como forma de conter as ações abusivas. Do mesmo modo, trabalharemos com os artigos 535º e 610º do CPC, com o intuito de perquirir se o legislador permitiu o provimento do mérito em ações carentes de interesse de agir e, em caso afirmativo, se estas poderiam ser consideradas hipóteses do abuso do direito de demandar. dc.description.abstract | The legal institute “abuse of procedural law” is aimed at repelling unfair behavior and against good faith. The subject, widely consolidated in Civil Law, is still not sufficiently debated by the procedural doctrine and of timid practical application by the jurisprudence. However, daily life shows that, every day, the litigants innovate in the use of expedients that contradict the essential purpose of the procedural act, aiming at a different objective. Given this framework, we will focus on the phenomenon of the multiplication of demands, both as a result of the fractionation of its object and the fractionation of its active or passive pole. From this analysis, we will see if there is an intrinsic relationship between the interest to act and the abuse of procedural law, so that assumption can be used as a way to contain abusive actions. In the same way, we will work with articles 535 and 610 of the CPC, in order to investigate whether the legislator allowed the merits to be granted in actions lacking an interest to act and, if so, whether they could be considered hypotheses of abuse of demand.
