Deste modo, divide-se o presente trabalho em duas partes: a primeira parte, dividida em dois capítulos, alusiva ao instituto da posse; a segunda, alusiva ao instituto da usucapião, e, igualmente, dividida em dois capítulos. O primeiro capítulo, da primeira parte, começa por abordar a noção de posse e respectivos elementos (corpus e animus), para, posteriormente, a distinguir da figura da detenção. Em seguida, abordam-se questões, menos pacíficas, tais como: posição adoptada pelo Código Civil Português, bens susceptíveis de posse e fundamento da tutela possessória. Desta primeira parte constam, ainda, explicitações acerca das características da posse: titulada/não titulada; boa/má fé; pacífica/violenta; pública/oculta. Já na segunda parte, dedica-se o primeiro capítulo ao fundamento da usucapião, bem como, a algumas questões ambíguas: (eventual) exigibilidade de indemnização e relevância do instituto da usucapião. Por fim – no segundo capítulo, da segunda parte –, abordam-se os pressupostos gerais, ínsitos ao instituto da usucapião: 1) Existência de posse; 2) Características sine qua non da posse, para efeitos de aquisição por usucapião; 3) Direitos usucapíveis; 4) Prazos da usucapião; 5) Imputabilidade da inércia; 6) Invocação, Judicial ou extrajudicial. Palavras-chave: Posse; Propriedade; Usucapião The goal of this thesis is to address some fundamental notions related to the institutes of ownership and usucapion, as well as some of its less peaceful aspects in the Doctrine and Jurisprudence. This thesis is compromised of two parts, each of those subdivided into two chapters, the first allusive to the institute of possession and the second to the usucapion. The first chapter of the first part begins by discussing the notion of possession and its elements (corpus and animus), later, to be distinguished from the figure of the detention. Then, less pacific issues are addressed, such as: the position adopted by the Portuguese Civil Code, assets that may be possessed and the foundation of possessory tutelage. This first part also includes explanations about ownership characteristics: titled / not titled; good / bad faith; peaceful / violent; public / hidden. In the second part, the first chapter is dedicated to the basis of usucapion, as well as some ambiguous questions: (possible) exigibility of compensation and relevance of the institute of usucapião. Finally - in its second chapter - general assumptions of the institute of usucapion is discussed: 1) Existence of possession; 2) Characteristics sine qua non of possession, for the purpose of acquisition by usucapião; 3) Usucable rights; 4) Deadlines of usucapião; 5) Imputability of inertia; 6) Invocation, Judicial or extrajudicial.
