Abstract: Dentre todas as modalidades de delinquência organizada e grave, o terrorismo ocupa posição de vanguarda na expansão de diversos modelos de política criminal pelo mundo, pois além de explorar os avanços tecnológicos e ser acompanhado por um forte apelo midiático e emocional, ao contrário dos demais crimes, não só busca, como depende de publicidade para subsistir. Apesar da atenção recebida no pós-11 de setembro, esse modo de violência política há muito é empregado como forma de desafio ao poder dominante, de modo que uma visão holística sobre a carga histórica que o acompanha pode auxiliar na busca de uma definição legal fidedigna. Na sequência, para enriquecer a discussão sobre os limites de intervenção estatal no combate ao terrorismo, faz-se a análise prática de modelos de reação que possuem substratos distintos. Para tanto, serão examinados (i) a normalização da via emergencial; (ii) a via híbrida entre Direito Penal e Direito de Guerra; e (iii) o expansionismo penal. Ao final, coloca-se em discussão o panorama jurídico-penal português, observando-se suas fontes externas de influência, evolução histórica, disposições em matéria de prevenção e investigação, além de questões de ordem penal substantiva e processual, bem como a nova Diretiva sobre a matéria, a qual irá descambar em iminente alteração da Lei de Combate ao Terrorismo. Por fim, juntamente com a análise crítica desse panorama, busca-se verificar suas (in)compatibilidades com os modelos de reação ora estudados, a fim de averiguar quais os erros e acertos do quadro legislativo português.
Amongst all modalities of organized and grave delinquency, terrorism occupies a vanguard position in the expansion of many criminal political models around the world, cause besides exploring technological advances and being accompanied by a strong emotional and mediatic appeal, in contrary to other crimes, not only it searches, as it depends on publicity to exist. Despite the attention received post September 11, this manner of political violence has long been used as a form of defiance to the dominant power, in a way that a holistic view over the historical load that goes with it can help in the search for a reliable legal definition. In sequence, to enrich the discussion about the limits of states’ intervention in the fight against terrorism, a practical analysis of reaction models with different substrates is carried out. To do so, will be examined (i) emergency’s path normalization; (ii) the hybrid path between Criminal Law and War Law; and (iii) the criminal expansionism. At the end, the Portuguese legal-criminal landscape is discussed, observing its external sources of influence, historical evolution, matter disposition in prevention and investigation, besides questions of substantive and procedural criminal order, as well as the new Directive on the subject, which will fall over an imminent alteration of the Combating Terrorism Act. Finally, conjointly with the critical analysis of this scenario, we seek to verify its (in)compatibilities with the reaction models currently studied, aiming to find out which are the hits and mistakes of Portuguese legislative framework.
