Proteção diplomática: a reformulação do sistema tradicional com base nas normas de jus cogens

Abstract

A constante evolução da sociedade gera, por consequência, a necessidade de evolução dos mais variados institutos jurídicos, seja em âmbito nacional, comunitário, mas principalmente internacional. Os desafios de um mundo globalizado encontram-se não apenas nas questões económicas, mercadológicas e políticas, sendo necessário depositar especial atenção nos mecanismos de proteção dos indivíduos no que toca sua parte humanitária e social. Certo é que nesse sentido o direito internacional evoluiu em conceito e prática, deixando, todavia, o instituto da Proteção Diplomática como um mecanismo rígido, retrógrado, de difícil acesso e caído em constante desuso pelos Estados. O surgimento de sujeitos de direito internacional para além dos Estados e de tribunais internacionais que visam a proteção dos direitos humanos geraram efeitos práticos, que ano após ano fazem os Estados declinarem na intenção de exercer a Proteção Diplomática sob argumentos, principalmente, da possibilidade de exercício discricionário. Contudo, faz-se necessário observar que a evolução progressiva do direito internacional, sobretudo por parte da Comissão de Direito Internacional das Nações Unidas (essencial para a formação das opiniões aqui expressas), permite-nos afastar o requisito da discricionariedade, bem como outros requisitos práticos, quando um estrangeiro tiver seus direitos violados no estrangeiro e esses direitos forem reconhecidos e aceitos como normas imperativas de direito internacional (conhecidas, portanto, como normas de Jus Cogens) e consequentemente adotar um regime jurídico reformulado ao sistema tradicional.

The constant evolution of society therefore results in the need for the development of a wide range of legal institutes, at national, Community and international level. The challenges of a globalized world lie not only in economic, market and political issues, but particular attention must be paid to the protection mechanisms of individuals with regard to their humanitarian and social aspects. It is true that in this sense international law has evolved in concept and practice, leaving the Institute of Diplomatic Protection as a rigid and retrogressive mechanism that is difficult to access and is constantly being disused by States. The emergence of subjects of international law besides the States and international tribunals aimed at the protection of human rights produce practical effects in which year by year States were declining of intention to exercise Diplomatic Protection arguing, in particular, the discretionary power of exercising. However, it should be noted that the progressive evolution of international law, especially by the United Nations’ International Law Commission (essential for the formation of the opinions here expressed), allows us to remove the requisite of discretion and other practical requisite when a foreigner has the own rights violated abroad and these rights are recognized and accepted as a peremptory norms of general international law (known, therefore, as a Jus Cogens norms) and consequently adopt a legal regime reformulated to the traditional system.
