Os Baldios Portugueses

Abstract

A presente dissertação tem como finalidade o estudo da figura singular da propriedade coletiva em Portugal, mais concretamente dos baldios e do seu regime jurídico. Será dado um foco inicial ao desenvolvimento histórico deste tipo de propriedade ao longo dos tempos, com especial foco no plano nacional, essencial para a compreensão de uma figura sui generis do nosso direito, temporalmente oscilante entre os espetro do Direito Privado e do Direito Publico, consagrando-se por fim numa individualidade comunitária intermédia.A natureza jurídica dos baldios foi desde sempre uma problemática não resolvida no nosso sistema jurídico, pelo que será alvo de uma análise profunda e específica, confrontando o seu regime com o da propriedade individual e comum, bem como desenvolvendo a sua relação com os demais institutos do Direito que aos baldios são estranhos. Será dado particular atenção à sua relação com a posse, a propriedade e a transmissão.Por fim, será efetuado um breve comentário à Lei nº 75/2017, de 17 de Agosto, sendo esta legislação recentemente aprovada, e por isso pouco explorada pela doutrina e pouco presente nas instâncias superiores dos nossos tribunais, fruto de controversas alterações legislativas que o regime regulador dos baldios tem vindo historicamente a sofrer. Não sendo aprofundada como talvez fosse merecedora, será feita uma apreciação às disposições que mais relevo apresentou a sua mudança, bem como uma consideração final genérica.________________________________

The purpose of this dissertation is the study of the singularity associated with the collective ownership of land in Portugal, specifically in regards to “Baldios” and it's legal framework. An initial focus will be given to the historical development of this type of ownership overtime, with particular emphasis on a national level, essential for the understanding of such a sui generis figure of our legal system, which historically has been oscillating between private and public law, ultimately finding it's place as an intermediate type of cummunity system.The legal nature of the “Baldios” has always been seen as an unresolved problem in our legal system. Therefore, it will be the subject of analysis, confronting its regime with the other insitutes of Law that to the “Baldios” are odd. Particular focus will be paid to its relationship to possession, ownership and forms of transmission.Lastly, a brief commentary will be made to the Law nº 75/2017, of August 17, being that this law has only recently been approved, and therefore has little been explored by the doctrine and has had little to no presence in our higher courts, which has been a result of controversial legislative changes. Although not examined in depth as it might be deserving, we will analyze with particular focus the legal provisions that have brought more prominance change to the regime, as well as a general final assessment.__________________________________________________________________________________________
