MUTAÇÃO CONSTITUCIONAL: estudos sobre a reforma informal da Constituição

Abstract

O presente trabalho tem como escopo analisar o instituto da mutação constitucional e para isso aborda, em seu início, os movimentos constitucionalistas e o histórico da Constituição, bem como o seu conceito e importância. Visa, em seguida, explicar como se dá a reforma formal da Lei Fundamental no Brasil e em Portugal e esclarecer a necessidade da evolução constitucional para acompanhar o dinamismo social. Ao longo do trabalho, são explicados a origem, as características, os pressupostos e os fundamentos das mutações constitucionais. Além disso, são explorados os mecanismos de atuação da reforma informal da constituição, com ênfase para a interpretação constitucional judicial, e, bem assim, para as correntes doutrinárias norte-americanas. Por fim, analisa-se a questão da existência ou não de limites às mutações constitucionais, com o fim de perceber se algumas mutações constitucionais promovidas pelo Supremo Tribunal Federal foram efetuadas de maneira correta ou se excederam os limites da reforma silenciosa, incorrendo em mutações constitucionais inconstitucionais. This thesis intends to analyze constitutional mutation and for that, it starts with an explanation of historical constitutional movements and the chronology of the firsts written constitutions, along with the concept of constitution and its significance. After that, it intends to explain the formal change of the Constitution, both in Brazil and in Portugal, and clarify the need of a constitutional evolution to keep the constitution up with social dynamics. Throughout the thesis, are explained the origin, characteristics, and other elements of the constitutional mutations. Furthermore, are explained the text intends to explore the means and procedures of informal changes of the constitution, with emphasis in the judicial constitutional interpretation and the north-American interpretations doctrines. Lastly, it aims to analyze the matter of limits of the informal constitutional changes, to assess if the constitutional mutations furthered by the Brazilian Supreme Court are legal or if they exceeded the limits of this silent changes, ruling unconstitutional changes
