Abstract: O Direito do Idoso à Autodeterminação nos Cuidados de SaúdeResumoA sociedade moderna enfrenta um grande problema a nível de demografia, problemática que levanta inúmeras questões, nomeadamente a desarmonia entre gerações. Face ao aumento da população idosa, motivada pela melhoria das condições de vida, de saúde e de alimentação, surgem as questões relativas ao envelhecimento. De entre os vários problemas que atualmente afetam a população idosa, destacamos as situações de dependência em relação a terceiros, motivadas pela perda de capacidade de decisão para os atos da vida diária, designadamente, das decisões relativas aos cuidados de saúde. Todavia, na maioria dos casos, a pessoa idosa apenas carece ser auxiliada para a tomada dessas decisões, porquanto ainda é capaz de querer e entender o sentido das suas declarações. Outras vezes, apenas deseja que a sua vontade seja considerada na eventualidade de um dia, essa capacidade de manifestar a sua vontade inexistir. Procuramos com o presente estudo a defesa do direito à autodeterminação do idoso no âmbito da saúde, através da análise das figuras que nos últimos tempos têm surgido em sua defesa e que têm como princípio o respeito pela dignidade da pessoa humana.É essencial e urgente uma reforma ao regime das incapacidades civis, de forma que aquele se torne mais conforme com os direitos fundamentais das pessoas idosas. THE RIGHT TO SELF-DETERMINATION OF THE ELDERLY IN HEALTHCAREAbstractModern society faces a major demography problem, a problem that raises a great number of questions, namely the disharmony between generations. Faced with the increasing elderly population, motivated by the improvement of living conditions, health and food, the issues related to aging arise.Among the diverse problems that currently affect the elderly population, we highlight the situations of dependence on third parties, motivated by the loss of decision-making capabilities for mundane acts of the everyday life, namely, decisions related to health care. In most cases, however, the elderly people only need to be assisted in making such decisions, since they still have wants and understand the meaning of their statements. Other times, the just want their will to be considered in the event the one day that ability to manifest their own will ceases to be a reality.Through this dissertation it is our goal to study and investigate the defense of the right to self-determination of the elderly in the health field, through the analysis of the legal constructs that have recently been emerging in its defense and whose core principle is the respect for the dignity of the human person.A reform of the civil incapacity regime is essential and urgent in order to be more in line with the fundamental rights of the elderly.
