O Novo Regime da Gestação de Substituição à Luz do Princípio da Igualdade

Abstract

Intitulada de O Novo Regime da Gestação de Substituição à Luz do Princípio da Igualdade esta dissertação de mestrado tem como objetivo esmiuçar as alterações operadas no regime jurídico da procriação medicamente assistida (PMA) que hoje, felizmente, consagra o acesso à gestação de substituição. Desta forma, com o intuito de fazer uma contextualização do objeto da presente dissertação, começa-se por efetuar um enquadramento sobre a temática em apreço no seio da lei agora aprovada com o novo acervo legal e, ainda, a sua relação e interseção com o direito a constituir família, direito este reconhecido na Constituição da República Portuguesa no seu artigo 36º, subdividindo-se no direito a fundar família e o direito ao casamento. Posteriormente, é analisada a gestação de substituição na sociedade atual, mais precisamente a noção e os problemas relacionados com a sua denominação, as modalidades que a constituem e uma breve exposição da motivação aliada à admissibilidade desta prática e, contrariamente, a argumentação usada pelos seus opositores.De seguida, efetuar-se-á a apresentação da evolução legislativa da gestação de substituição assim como se introduzirá a Lei n.º 25/2016, de 22 de agosto que legalizou o acesso a esta prática no ordenamento jurídico português. Por último, mas sem dúvida o ponto fulcral e mais importante da presente dissertação, diz respeito à ligação entre o princípio da igualdade e o acesso à gestação de substituição, pelo que será, neste sentido, realizada a análise crítica à recente alteração legislativa desta matéria. Em suma, a questão a solucionar reside em: estará o novo regime do acesso à gestação de substituição em conformidade com o princípio da igualdade?

Named “The New Regime of surrogacy in the Light of the principle of equality” this thesis aims to anaylise in depth the alterantions made to the judicial system of the assisted reproduntion that, today, luckly includes the access to surrogacy.In this way, with the intent to make a contextualization about the object of this thesis, we begin by framing the subject of this thesis in the context of the new law that was now approved and, also, its relation and intersection with the right to start a family that is recognized in the Constitution of the Portuguese Republic in its article 36º, where it is divided between the right to start a family and the right to marry.Afterwards, the surrogacy is analysed in the context of our current society, precisely its notion and the problems reletad with its naming, the types of surrogacy and also a short exposure of the motivations combined with the admissibility of this practice and also the points made in contrast by their opponents.Thereafter, we proceed to enunciate the legislative developments regarding the surrogacy as well as introduncing the Law no. 25/2016, of 22th August that legalized the access to this practice in the Portuguease legal system.Lastly, but without a question the fundamental point of this thesis, is the expousure of the connection between the principle of equality and the access to surrogacy. Therefore, it will be made a critical analysis of this recent legislative development.In sum, the question that we intend to resolve is: does the recente legal regime about surrogacy is in accordance with the principle of equality?
