Abstract: A presente dissertação visa explorar, entender e questionar criticamente o emergente movimento jurídico-político de criminalização do Enriquecimento Ilícito verificado, nos últimos anos, em Portugal e pelo mundo fora. Na prossecução desse mesmo fim, tencionamos analisar o fenómeno do Branqueamento de Capitais, figura que lhe deu origem, mais concretamente as suas raizes históricas e as motivações políticas e económicas que a despoletaram, os circundantes regimes penais, fiscais e civis ao Enriquecimento Ilícito, como o Confisco das Vantagens do Crime, a Perda Alargada e a Tributação de Rendimentos Ilícitos, terminando com a contemplação da possível existência de um dever de justificação de património. Iremos também analisar brevemente a figura dos Impostos Confiscatórios, tentado responder à pergunta ‘Quando é que um Imposto se torna num confisco?’.Explicitaremos, de igual forma, na nossa dissetação, os institutos de confisco civil presentes no sistema jurídico inglês e norte-americano, para reflectir sobre as vantagens e os infortúnios destes mecanismos legais de contorno e facilitação das exigências constitucionais e penais que um Estado de Direito deve inevitavelmente impor.E terminaremos com uma análise e tentativa de resposta à questão central que nos iniciou no estudo das várias figuras abordadas na dissertação, a ponderação da existência de um dever de justicação de património, se este dever é compatível com o nosso ordenamento jurídico e se não será esse o caminho que as correntes políticas internacionais parecem tomar.
The present dissertation strives to explore, understand and critically question the rising legal and political movement of criminalizing Illicit Enrichment, noticed, in the past years, in Portugal and throughout the world. In the pursuit of that very goal, we will analyse the Money Laundering phenomenon, which gave birth to the illicit enrichment institute, more specifically, its historical roots and the political and economic motivations that gave it rise, the surrounding criminal, fiscal and civil figures, such as the Confiscation of the Proceeds of Crime, the Extended Forfeiture (our translation), and the Taxation of Illicit Income, finishing with a pondering of the possible existence of a duty of justifying one’s property. We shall also analyse briefly the idea of Confiscatory Taxes, trying to answer the question ‘When does a tax become a confiscation?’.We shall elucidate, as well, in our dissertation, the civil forfeiture figures present in the English and North American legal systems, to reflect upon the advantages and misfortunes of these legal mechanisms of circumventing and facilitating the constitutional and criminal requirements that a State of Law should inevitably impose.And we shall finish with an analysis and an attempt of answering the central question that set us upon the study of the various figures approached in this dissertation, the pondering of the existence of a duty of justification of property, if this duty is compatible with our legal system and if that is not the path that the international political currents seem to take.
