A indústria espacial em Portugal: os contratos comerciais espaciais

Abstract

A emergente indústria espacial vem ganhando força no mercado e seus produtos e serviços têm se tornado cada vez mais indispensáveis no cotidiano atual. Observe-se, por exemplo, as atividades essenciais como controle aéreo, meteorologia, posicionamento global, comunicação e radiofusão, além de outras, que só são possíveis graças aos satélites. Em consequência disso, muitos países vêm buscando desenvolver estratégias para incentivar esse setor a nível nacional, dentre eles Portugal. Devido a importância deste assunto, nomeadamente em Portugal em virtude de sua atual estratégia de investigação, inovação e crescimento, em que as atividades espaciais ganham importante destaque e a criação de uma legislação específica para esse setor é posta como um objetivo, bem como devido ao escasso material existente sobre o assunto, este trabalho teve por objetivo analisar o regime jurídico aplicado a indústria espacial em Portugal, nomeadamente aos contratos comerciais espaciais. Inicialmente foi feito um estudo sobre a indústria espacial e seu desenvolvimento na Europa e em Portugal. Em seguida foi abordado o panorama jurídico para o desenvolvimento de projetos espaciais na Europa. O próximo passo foi o estudo do regime comercial em Portugal, para com base nisto realizar a análise da situação dos contratos comerciais espaciais a luz da legislação portuguesa. Por fim, foi abordado o projeto de lei n. 251/2017, aprovado recentemente e que regula um regime de acesso e exercício de atividades espaciais em Portugal.

The emerging space industry has been gaining strength in the market and its products and services are becoming increasingly indispensable in today's lifestyle. Take, for instance, essential activities such as air control, meteorology, global positioning, communication and radiofusion, among others that are only possible thanks to the use of satellites. As a result, many countries are seeking to develop strategies to encourage this sector at the national level, and one of these countries is Portugal. Due to the importance of this subject, namely in Portugal owing to its current research, innovation and growth strategy, in which space activities gain important prominence and the creation of a specific legislation for this sector is set as one of the main objectives, as well as due to the scarce material available on the subject, this work aimed to analyse the legal regime applied to the space industry in Portugal, in particular to the case of commercial space contracts. Initially a study was made on space industry and its development in Europe and Portugal. In a next phase, the legal framework for the development of space projects in Europe was discussed. The next step was the study of the commercial law in Portugal, based on this was carry out the analysis of the situation of commercial space contracts under Portuguese legislation. Finally, a study was made on Bill n. 251/2017, a recently approved bill that regulates a regime of access and exercise of space activities in Portugal.
