Abstract: A presente dissertação refere-se à responsabilidade civil da Administração Pública no âmbito da Gestão Urbanística. Na mesma é feita uma explanação sobre o controlo prévio nos procedimentos de comunicação prévia, licenciamento e autorização de utilização. Assim, começo por abordar os pressupostos da responsabilidade civil pois, são necessários estarem preenchidos certos requisitos para que se possa dizer que, perante determinada situação, o Estado, órgãos, agentes e funcionários serão civilmente responsabilizados perante o interessado.Posteriormente, irei abordar os procedimentos urbanísticos como, a comunicação prévia, o licenciamento e a autorização de utilização. Nestes procedimentos irei fazer uma breve explanação dos vários procedimentos bem como, do controlo preventivo que é feito em cada um deles.A questão que pretendo dar resposta no âmbito da presente dissertação é a seguinte: Estando perante procedimentos de operações urbanísticas que se alicerçam em pareceres técnicos até que ponto deve o município responder civilmente perante o interessado em caso do procedimento ser revogado, anulado ou declarado nulo?Para conseguir dar resposta à questão supramencionada importa analisar não só o Regime Jurídico da Urbanização e Edificação, como também a Lei n.º 40/2015 de 01 de junho assim como, a própria Constituição da Republica Portuguesa.Feita esta breve análise aos procedimentos das operações urbanísticas teremos de concluir que com a Administração Pública, leia-se município, respondem de forma solidária os seus órgãos, agentes e funcionários.Este alargamento da responsabilidade da Administração Pública resultou da última alteração ao RJUE. Assim, estando preenchidos os pressupostos da responsabilidade civil os agentes, órgãos e funcionários que atuem com manifesta falta de diligência serão responsáveis pelo prejuízo causado ao interessado.A comunicação prévia, o licenciamento e a autorização de utilização são operações urbanísticas passíveis de serem anuladas ou declaradas nulas. A comunicação prévia não pode ser revogada mas pode, cessar os seus efeitos por força de caducidade bem como, a licença. Por sua vez o procedimento de licenciamento bem como, a autorização de utilização podem ser revogados.Conclui-se ainda, que a comunicação prévia tem um controlo menos apertado que os procedimentos de licenciamento e de autorização de utilização. Parece este controlo prévio no âmbito destes dois últimos procedimentos justificável pelo facto de já estarmos perante o campo de direitos adquiridos do interessado enquanto que, a comunicação prévia é só a apresentação da pretensão e do projeto ao presidente da Câmara Municipal que, estando cumpridos os pressupostos legais e regulamentares, a não pronúncia do mesmo, quanto à pretensão do interessado, decorrido o prazo legal, é lida como um ato permissivo ao pedido apresentado.No entanto, sendo que os projetos são subscritos por técnicos que são civilmente responsáveis pelos mesmos o que se questionou foi até que ponto deveria a Administração Pública, bem como os seus agentes, órgãos e funcionários também responsabilizados. Ora, conclui-se que uma tese que se apoiasse na desresponsabilização do Estado bem como, dos seus agentes se traduziria numa teoria inconstitucional, por ser violadora do artigo 22.º da CRP e ilegal, por ser contrária ao artigo 70.º, do RJUE.A Administração Pública, bem como os seus agentes estão encarregues de emitirem atos no âmbito da gestão urbanística que poderão ser passíveis de anulabilidade, nulidade e revogação. Ora, não podemos olvidar que a Administração pública está vinculada ao princípio da prossecução do interesse público que, neste sentido, parece compreensível que a mesma e os seus agentes sejam, direta ou indiretamente, responsabilizados civilmente pelo erro na ação ou na omissão no exercício da função administrativa.A primeiro diploma que previu a responsabilidade administrativa nesta temática foi o Decreto-lei 555/99, de 16 de dezembro tendo sido, posteriormente, alterado pela Lei 60/2007, de 04 de setembro e pelo Decreto-Lei n.º 136/2014, de 9 de setembro.As alterações traduziram-se, essencialmente, numa maior amplitude do princípio da responsabilidade, no alargamento do âmbito subjetivo da responsabilidade solidária e na introdução de mecanismos de controlo preventivo, reforçando-se a responsabilidade disciplinar. Na redação inicial do artigo 70.º do RJUE a responsabilidade surgia quando em causa estivesse uma situação de “revogação, anulação ou declaração de nulidade de licenças, comunicações prévias ou autorizações de utilização”. Esta era uma lista taxativa, no entanto, com a alteração de 2014 esta norma passou a ter um caráter meramente exemplificativo tendo sido alargada a responsabilidade, não só por ação como também por omissão da Administração Pública.Comecei por abordar os pressupostos da responsabilidade civil, a evolução do RJUE e depois, desci para o âmbito do controlo preventivo nas operações urbanística
5000/5000The present dissertation refers to the civil responsibility of the Public Administration in the scope of Urban Management. In the same one is made an explanation on the previous control in the procedures of previous communication, licensing and authorization of use. I therefore start by addressing the assumptions of civil liability, since it is necessary to fulfill certain requirements in order to be able to say that, given the situation, the State, organs, agents and employees will be civilly liable to the interested party. Such as prior communication, licensing and authorization of use. In these procedures I will make a brief explanation of the various procedures as well as of the preventive control that is done in each one of them. The question that I intend to answer in the scope of this dissertation is the following: Being before procedures of urban operations that are based on opinions To what extent should the municipality respond civilly to the interested party in case the procedure is revoked, annulled or declared void? In order to answer the above question, it is important to analyze not only the Legal Regime of Urbanization and Edification, but also Law no. 40/2015 of 01 June, as well as the Constitution of the Portuguese Republic itself.Having done this brief analysis to the procedures of the urban operations we will have to conclude that with the Public Administration, read municipality, they respond in a solidary way their organs, agents and employees.This extension of the responsibility of the Public Administration resulted from the last change to the RJUE. Thus, once the assumptions of civil liability are fulfilled, agents, organs and officials acting with a manifest lack of diligence will be responsible for the loss caused to the interested party.Prior notification, licensing and authorization of use are urban operations that can be annulled or declared null and void. Prior notification may not be revoked but its effects may cease to lapse as well as the license. In turn the licensing procedure as well as the authorization of use can be revoked.It is also concluded that the prior notification is less tightly controlled than the licensing and authorization procedures.It seems that this prior check in the scope of the latter two procedures is justified by the fact that we are already before the field of acquired rights of the interested party, whereas the prior communication is only the presentation of the pretension and the project to the mayor of the City that, having fulfilled the assumptions Legal and regulatory, the non-pronouncement of the same, regarding the claim of the interested party, after the legal deadline, is read as a permissive act to the application filed.However, since the projects are subscribed by technicians who are civilly responsible for them, what was questioned was the extent to which the Public Administration, as well as its agents, organs and employees are also responsible.It is concluded that a thesis based on the lack of accountability of the State and its agents would be translated into an unconstitutional theory, because it violates Article 22 of the CRP and is illegal, because it is contrary to Article 70 RJUE.The Public Administration and its agents are in charge of issuing acts in the scope of urban management that may be subject to cancellation, nullity and revocation. However, we can not forget that public administration is linked to the principle of the pursuit of the public interest, which, in this sense, it seems understandable that it and its agents are, directly or indirectly, civilly liable for the error in the action or omission in the exercise of Administrative function.The first decree that provided for administrative responsibility in this area was Decree-Law 555/99, dated December 16, and was subsequently amended by Law 60/2007, of September 4 and by Decree-Law No. 136/2014 , Of 9 of September.The amendments essentially reflected a broader scope of the principle of liability, an extension of the scope of joint liability and the introduction of preventive control mechanisms, and a reinforcement of disciplinary liability.In the original wording of Article 70 of the RJUE, liability arose when a situation of "revocation, cancellation or declaration of invalidity of licenses, prior communications or authorizations for use" was concerned. This was a strict list, however, with the amendment of 2014, this standard was merely exemplary and responsibility was extended, not only by action but also by omission of the Public Administration.I began by addressing the assumptions of civil liability, the evolution of the RJUE and then, I went down to the scope of preventive control in urban planning operations
