Violência Doméstica e Mediação Penal (In)Compatibilidade na Aplicação

Abstract

The present dissertation's purpose is the analysis of the application of penal mediation in cases of domestic violence. This dissertation begins with an analysis of the domestic violence crime, dividing up between its juridical notion, it legal evolution in our juridical order, its legal interest, its objective type and subjective type and its juridical nature. Afterwards, an approach is made to the theme of restorative justice. This approach includes the purposes and the principles of this type of conflict resolution, as well as its instruments, giving a bigger focus to penal mediation, namely its requirements and the legal changes made to its regime. In the last part of this dissertation, a discussion is made about the arguments in favor and against the public nature of the domestic violence crime and the divergence around the current material scope of penal mediation. A presente dissertação tem como objectivo analisar a aplicação da mediação penal a casos de violência doméstica. A dissertação inicia-se com uma análise ao crime da violência doméstica repartindo-se entre o seu conceito jurídico, a sua evolução legislativa no nosso ordenamento jurídico, o seu bem jurídico, o seu tipo objectivo e tipo subjectivo e a sua natureza jurídica. Posteriormente, é feita uma abordagem ao tema da justiça restaurativa. Esta abordagem inclui os objectivos e os princípios deste tipo de resolução de conflitos, assim como os seus instrumentos, dando uma análise mais extensiva à mediação penal, nomeadamente os seus requisitos e as alterações feitas ao seu regime legal. Na parte final desta dissertação, discute-se os argumentos a favor e contra a natureza pública do crime de violência doméstica, assim como a divergência em torno do actual âmbito material da mediação penal.
