Influências recentes da neurociência nos planos político, normativo e prático do direito penal

Abstract

O advento de complexas e inovadoras tecnologias biomédicas tem levado a uma crescente utilização das evidências neurocientíficas na solução dos novos desafios enfrentados pelo Direito. Dentre os ramos jurídicos mais influenciados pelas ciências naturais destaca-se o Direito Penal, que tem se utilizado cada vez mais destes conhecimentos na busca pela consecução ótima dos seus fins sociais. Tais substratos têm auxiliado a resolução de diversas questões complexas que se apresentam ao penalista. Destacam-se, dentre outras, as discussões sobre os limites etários da maioridade penal, a permissão da interrupção terapêutica de gestações de fetos acometidos por malformações congênitas letais, como a anencefalia, e as tormentosas questões que circundam o reconhecimento ou não da inimputabilidade penal de ofensores acometidos por efeitos de anomalias psíquicas. Tais dilemas têm levado legisladores, juízes e os demais operadores do Direito Penal a buscar socorro junto ao saber de especialistas de outras disciplinas, como a Biologia, a Medicina e a Psicologia, enquanto partes da Neurociência, de forma a melhor compreender o funcionamento do cérebro e suas relações com a vida e o modo de ser do homem. A presente dissertação tratará da relação entre o Direito Penal moderno e o saber neurocientífico, de forma a promover reflexões sobre a importância da abertura do sistema jurídico contemporâneo à valoração dos elementos extrajurídicos para realização da mais lídima justiça. The emergence of complex and innovative biomedical technologies has led to a growing use of neuroscientific evidence in solving the new challenges faced by Law. Among the fields of Law that are more influenced by the natural sciences, the criminal Law has stood out as the preferential user of these findings to reach the optimal achievement of its social purposes. These insights have helped to solve complex issues that are presented to the criminalists. Of note are the discussions on the age limits of criminal responsibility, the allowance of therapeutic interruption of pregnancies which fetuses are affected by lethal congenital malformations, such as anencephaly, and the tormenting questions that concern the (non-) recognition of criminal responsibility of offenders whose unlawful acts are committed under influence of the effects of a mental disorder. Such dilemmas have led lawmakers, judges and other operators of criminal law to seek help from the expertise of other disciplines, such as biology, medicine and psychology, as parts of neuroscience, to better understand the functioning of the brain and its relations with man’s life and way of being. This thesis will address the relationship between modern criminal law and the neuroscientific knowledge, aiming to promote meditations on the importance of opening the contemporary legal system to the valuation of nonlegal elements for the accomplishment of legitimate justice.KEY-WORDS: Criminal Law; Neuroscience; Age Limits of Criminal Responsibility; Anencephaly; Mental Disorder
