A desconstrução e sua influência no direito: uma relação complexa.

Abstract

A presente dissertação tem como escopo a elucidação do pensamento conhecido como desconstrução – a partir da análise de determinadas obras, tanto de seu pensador (filósofo franco-argelino Jacques Derrida), quanto pela ajuda de textos que contribuem para seu entendimento – para compreensão de sua influência e assimilação pelo direito, através da análise dos textos desenvolvidos pelo jurista norte-americano Jack Balkin, bem como pelos textos que o mesmo desenvolve em companhia ao jurista Sanford Levinson, divindo-se em três trechos (que se subdividem em cinco capítulos). O primeiro trajeto cumpre traçar a desconstrução como gesto de leitura, como pensamento e como pensamento do outro, através dos motivos da hospitalidade. O segundo trecho analisa o motivo da justiça da desconstrução e sua direta influência no direito. O terceiro trecho cumpre tratar a desconstrução como ferramenta metódica, ou como instrumento, através da análise da teoria crítico-ideológica do direito de Jack Balkin, e dos efeitos da desconstrução na decisão judicial, através da analogia “direito como performance”. Ao final, traçam-se considerações que envolvem as lições de Jacques Derrida, para compreender o contexto em que o filósofo critica e compreende o direito, bem como a perspectiva de Jack Balkin (e sua projeção ao direito), para então situar as diferenças e adaptações/limitações que o jurista realiza das lições de Derrida. Por último, realiza-se uma reflexão crítica das projeções da desconstrução ao direito por ambos autores.PALAVRAS-CHAVE: Desconstrução, Direito, Jacques Derrida, Jack Balkin.

The purpose of this dissertation is to elucidate the thought known as deconstruction – from the analysis of certain works by his thinker (the french-algerian philosopher Jacques Derrida) and by the help of texts that contribute to its understanding – to understand its influence and assimilation by law, through the analysis of the texts developed by the american jurist Jack Balkin, as well as by the texts that he develops in company with the lawyer Sanford Levinson, being divided in three sections (that are subdivided into five chapters). The first section deals with deconstruction as a gesture of reading, as thought and thought of the other, through the motives of hospitality. The second section analyzes justice as a motive of deconstruction and its direct influence on the law. The third section deals with deconstruction as a methodical tool, or as an instrument, through the analysis of the critical-ideological theory of Jack Balkin, and of the effects of deconstruction on the judicial decision, through the analogy of "law as performance." In the end, Jacques Derrida's lessons are drawn to understand the context in which the philosopher criticizes and understands the law, as well as the perspective of Jack Balkin (and his projection to law), in order to situate the differences on the adaptations/limitations that the jurist makes of Derrida's lessons. Finally, a critical reflection of the projections of the deconstruction in the law by both authors is carried out.KEYWORDS: Deconstruction, Law, Jacques Derrida, Jack Balkin.
