O Cibercrime como móbil para a prática de atos terroristas

Abstract

Esta dissertação surge num momento de viragem do paradigma do crime de terrorismo. Se é inegável que este é um tipo de crime que pelo seu resultado e mediatismo imprime pressão sobre as instituições decisoras e dissemina pela população o sentimento de insegurança e de terror, não é menos verdade que este crime conheceu um novo campo de aplicação, seja como auxiliar ou catalisador dos efeitos do terrorismo, seja como próprio veículo para a prática do terrorismo. Esta dissertação terá o propósito de explorar esta nova forma mais ampla de terrorismo no espaço digital, num momento em que as novas tecnologias da sociedade da informação dominam o quotidiano de Estados, empresas e cidadãos. Esta nova forma mais ampla de terrorismo no espaço digital, o chamado ciberterrorismo será, enfim, o objeto de estudo desta dissertação, na sua vertente como veículo ou auxiliar para a prática do terrorismo, ainda que se trate de uma realidade por demais pouco explorada internacionalmente e inclusivamente em Portugal. Por ser uma expressão mais ampla de terrorismo será também objeto de estudo a Lei do Combate ao Terrorismo assim como, mas de forma mais sucinta, a Lei do Cibercrime. A par do estudo destas Leis, a breve trecho, tentaremos colmatar a ausência de regulação sobre esta matéria e tentaremos oferecer soluções assim que pertinentes. Esta dissertação será composta por três capítulos, o primeiro versará sobre o terrorismo, o segundo sobre o cibercrime e o terceiro, e por fim sobre o ciberterrorismo.

This dissertation arises at the moment of the paradigm shift of the crime of terrorism. If it is undeniable that this is a type of crime that through its results and mediatism, puts pressure on the governments, as also disseminates terror and the feeling of insecurity among companies and among the population, it is no less true that this crime has a new field of application, such as auxiliary or catalyst of the terrorism’s effects, or as a vehicle for the practice of terrorism. This dissertation aims to explore this new form of terrorism in the digital space, at a time when new technologies of the information’s society dominate the daily lives of states, companies and citizens. This new broader form of terrorism in the digital space, the so-called cyberterrorism will, in short, be the object of study of this dissertation, in its aspect as a vehicle or auxiliary to a practice of terrorism, although, without doubt, that this is a reality little explored internationally and also in Portugal. For being a broader new expression of terrorism, we will also take our time to study the Law on Combating Terrorism and, as well as, but more succinctly, the Law of Cybercrime.Along with the study of these Laws, in the short term, we will try to surpass the absence of specific regulation on this matter and we will try, as well, to offer solutions as soon as pertinent. This dissertation will have three chapters the first one will be about terrorism, the second one will be about cybercrime and at last, the last one, about cyberterrorism.
