Registo criminal de condenados por crimes contra a liberdade e autodeterminação de menores

Abstract

A problemática do âmbito dos crimes sexuais contra menores tem vindo a merecer cada vez mais atenção por parte do legislador. Assim, no ano de 2015 em virtude da Directiva e da Convenção de Lanzarote, o legislador português introduz inúmeras alterações à lei substantiva e processual, uma das mais relevante foi a criação do registo criminal de condenados contra a liberdade e autodeterminação sexual aproximando-se por conseguinte de correntes que defendem a publicitação do mesmo. Cabe-nos no âmbito do nosso trabalho não só expor o que é defendido por estas, mas também apreciar criticamente o resultado legislativo alcançado à luz da nossa constituição. The problematic of sexual crimes against minors has been getting more attention by the legislator. So, in 2015, by virtue of the Lanzarote's Convention and Directive, the portuguese legislator introduces countless changes to the processual and substantive law, one of the most relevant ones being the creation of the criminal registry of people condemned against liberty and sexual self-determination, therefore being closer to those lines of thought that defend the publication of that registry. In the theme of our thesis, it is our objective not only to expose what is defended by these lines of thought, but also to critically judge the legislative result achieved in light of our constitution.
