Abstract: A economia digital difere da economia tradicional na medida em que aquela possibilitou o surgimento de novos modelos de negócios. Estes novos modelos de negócios têm como característica em comum a venda de bens e serviços via dispositivos eletrônicos conectados à Internet. Em uma economia demasiadamente globalizada, na qual empresas multinacionais realizam operações comerciais em todo o globo através da Internet, constata-se a inexistência de fronteiras físicas entre países, assim, novos mercados são alcançados em nível sem precedente. Isso acontece porque a economia digital torna desnecessária a presença física da empresa multinacional nos países em que atua e onde possui clientes. Em termos de tributação, isso dificulta ao país consumidor (Estado da fonte) exercer a tributação dos rendimentos gerados em seu território pelas atividades da empresa estrangeira digital, mormente em razão de planeamentos fiscais bem elaborados. O presente trabalho tem como escopo identificar os problemas respeitantes à tributação sobre o rendimento das empresas multinacionais que operam na economia digital de bens intangíveis a nível global, sob o ângulo do Estado da fonte do rendimento. Busca-se também identificar as soluções propostas para que referidos rendimentos sejam tributados adequadamente (inclusive, sob o enfoque dos relatórios produzidos pela Organização para a Cooperação e Desenvolvimento Econômico - OCDE no contexto do programa “Base Erosion and Profit Shifting” – BEPS). Ao final, o autor aponta o caminho que, no seu entender, é o mais apropriado de ser seguido para que os países consumidores consigam exercer legitimamente seu poder tributário sobre o rendimento gerado no comércio eletrônico direto pelas empresas multinacionais.
The digital economy differs from the traditional economy because it made possible the emergence of new business models. What these new business models have in common is the sale of goods and services via electronic devices connected to the Internet. In a globalized economy, in which multinational corporations conduct business operations across the globe by using the Internet, there is no physical boundaries between countries anymore, so that new markets are reached at an unprecedented level. This occurs because the digital economy do not require a physical presence of a multinational enterprise in countries where it operates and have consumers. Regarding taxation, this makes it difficult for the consumer country (source country) to tax the income of the foreign company's activities produced in its territory, mainly because of well-prepared tax planning adopted by the company. The objective of this paper is to identify the problems related to taxation of the income of multinational enterprises operating worldwide in the digital economy (regarding goods and services sold online), from the point of view of the source state. It also seeks to identify the proposed solutions so that their income are properly taxed (including the suggestions contained in the reports produced by the Organisation for Economic Co-operation and Development -OECD in the context of the "Base Erosion and Profit Shifting" - BEPS program). In the end, the author points out the path that, in his opinion, is the most appropriate one to follow in order for consumer countries (source countries) to legitimately exercise their tax power over income of multinational enterprises in the digital economy.
