Abstract: A presente monografia tem por objetivo compreender em relação ao trabalho a favor da comunidade (TFC), de que modo é compreendido o compromisso legal estabelecido por esta medida, para com a reprovação e a reparação, tendo por base as perspetivas dos diferentes agentes do Sistema de Justiça para a sua execução.Em contexto estágio, realizado na Equipa Algarve 2 pertencente à Direção-Geral de Reinserção e Serviços Prisionais, procurou-se chegar a contacto com os vários intervenientes do sistema de justiça que estão envolvidos na aplicação e execução desta medida consagrada no Código Penal Português. Referimo-nos aos magistrados judiciais, às entidades beneficiárias do trabalho (EBT), aos prestadores de trabalho comunitário (PTC) e aos técnicos superiores de reinserção social (TSRS), com o intuito de compreender especificamente de que modo perspetivam esta medida e se veem efetivados os objetivos preconizados. Explanando-se ainda as fragilidades que esta medida apresenta, no sentido de se proceder a propostas para colmatá-las.Procedendo-se neste sentido a uma investigação de cariz qualitativo, exploratório e centrado na investigação-ação, utilizando como técnicas de recolha de dados a observação, bem como, a entrevista – presencial, via email e via telefone.Da investigação realizada discorrem como conclusões fulcrais que existe por parte de TSRS’s e EBT’s alguma incerteza quanto à interiorização da medida por parte dos condenados, contudo esta perspetiva não invalidou que os três grupos considerados, integrem a medida de trabalho a favor da comunidade como sendo efetivamente uma medida reparadora para a sociedade e reprovadora do ilícito praticado. Esta conclusão ganha substância aquando se olha para a perspetiva que técnicos e entidades têm acerca da utilidade do trabalho que é prestado e da efetivação dos objetivos que a medida preconiza, tal como, quando estas perspetivas são colocadas em confronto com os argumentos recolhidos junto dos condenados.Remata-se indicando que per si a medida cumpre com os objetivos reparadores e reprovadores, perante a sociedade e o crime (respetivamente) sendo esta a máxima veiculada pelos agentes do sistema de justiça considerados para efeitos da investigação, contudo defende-se a importância de todos os envolvidos na aplicação e cumprimento da medida, para que esta não perca substância e, por esta via, seja pervertida.
The main purpose of this monograph is to understand the relashionship between Community Work, how it is understood the legal commitment established by this measure towards reprobation and reparation, being based on the System of Justice for its execution. During the realized internship, carried out in the Equipa Algarve 2 belonging to the Direção-Geral de Reinserção e Serviços Prisionais, we tried to reach out to the various actors of the Justice System involved in the aplication and execution of this measure enshrined in the Portuguese Penal Code. We refer to judicial magistrates, beneficiaries of work, community service providers and Superior Technicians of Social Reinsertion, in order to understand specifically how they are looking at this measure and see the objectives set. Explaining the weaknesses that this measure presents, in the sense of making proposals to fill them.A qualitative, exploratory investigation and action-research centered was carried out in this direction, using observation techniques as data collection techniques, as well as the face-to-face interview, email and telephone.The research carried out concludes that exist on the part of TSRS's and EBT's some uncertainty towards the internalization of the measure by the condemned, however, this perspective did not invalidate the fact that the three groups considered included the measure of work in favor of the community as effectively being a remedial measure for society and reproving the wrong committed. This conclusion gains substance when one looks at the perspective that technicians and entities have about the usefulness of the work being done and the effectiveness of the objectives that the measure advocates, such as when these perspectives are confronted with the arguments gathered with the condemned.It is pointed out that per si the measure fulfills the reparative and reprobating objectives, vis-a-vis society and crime (respectively), which is the maximum of the agents of the justice system considered for the purposes of the investigation, but it is defended the importance of all involved in the application and enforcement of the measure, so that it does not lose substance and, by this way, is perverted.
