dc.description.abstract | O direito à greve é um direito fundamental, consagrado na Constituição da República Portuguesa - CRP (número 1 do artigo 57.º). Trata-se do mais importante meio reivindicativo dos trabalhadores. Todavia, não se trata de um direito absoluto, carecendo de ser harmonizado com outros direitos fundamentais, que correspondam a necessidades sociais impreteríveis. Com a finalidade de assegurar a satisfação dessas necessidades, o legislador constitucional previu a obrigação de serviços mínimos (número 3 do artigo 57.º da CRP), também vertida na lei ordinária (artigo 537º do Código do Trabalho), e que será assegurada pelos próprios trabalhadores. Trata-se de uma restrição a um direito fundamental com estatuto de direito, liberdade e garantia, que deve, assim, ser ponderada com o princípio da proporcionalidade em sentido amplo (número 2 do artigo 18.º da CRP) A presente investigação procura entender e densificar o conceito de necessidades sociais impreteríveis - traçando linhas de fronteira com o mero transtorno ou impacto no bem-estar dos utentes - percorrendo o quadro legal em vigor e a sua evolução histórica. Através da análise de decisões de fixação de serviços mínimos, quer pela via arbitral, quer pela via administrativa, procura identificar critérios casuísticos e linhas de tendência, ponderados nesta operação, no âmbito dos sectores dos correios, transportes rodoviários e actividade de enfermagem. dc.description.abstract | The right to strike is a fundamental right, provided by the Constitution of the Portuguese Republic (article 57 (1)). This is the most important instrument of workers' demands. However, it is not an absolute right, and it needs to be harmonized with other fundamental rights, which correspond to essential social needs. In order to ensure the fulfillment of these needs, the constitutional legislator conceded the minimum services obligation (number 3, article 57 of the Constitution of the Portuguese Republic), also provided in ordinary law (article 537 of the Labor Code), which will be assured by the workers themselves. It is a restriction of a fundamental right with a status of right, freedom and guarantee, which must, therefore, be considered with the principle of proportionality in the broad sense (Article 18 (2) of the Constitution of the Portuguese Republic) The present research seeks to understand and densify the concept of essential social needs - drawing boundary lines with the mere inconvenience or impact on the well-being of the users - going through the present legal framework and its historical evolution. Through the decisions’ analysis to fix minimum services, either by arbitration or by administrative means, it seeks to identify casuistic criteria and trend lines, weighted in this operation, in scope of the postal services, road transports and nursing activity.
