Justiça Restaurativa e Violência Doméstica contra mulher: A mediação penal como solução alternativa ao conflito

Abstract

Domestic violence, despite being an old subject, still remains present in our society. Even with all the feminist fight for gender equality the violence between spouses is still common and frequent. And considering how difficult it is for the offended wife to report her aggressor (for different motives), it becomes difficult for the State to punish these aggressions and solve the issue. One of the reasons that prevent the woman's denunciation of violence is the lack of efficacy of the penal system. Because they don't believe in the punishment of the aggressor and, in addition to that, being afraid of an even more violent reaction after the denunciation is done, the victims choose to remain silent.Taking into consideration this scenario, the present work will discuss new alternatives to solve the matter, with focus on penal mediation. Initially the recovery justice will be analyzed along with its principles and application through mediation. Following that, the crime of domestic violence will be addressed, its legal nature, how Portuguese legal deliberation faces this offense and the reasons hidden behind all violence committed against women. Finally, linking the studied subjects on the first two chapters, it will be analyzed, on the third part, the possibility of applying this alternate mechanism to the crime of domestic violence.It's known that today, in Portugal, the practice of penal mediation on crimes of domestic violence isn't allowed. Nevertheless, the present work opted to expose the factors that strengthen this prohibition, contesting them with arguments that defend the use of mediation.

A violência doméstica, apesar de se tratar de um assunto antigo, ainda permanece presente em nossa sociedade. Mesmo com toda a luta feminista pela igualdade de gênero, é comum e corriqueira a violência entre cônjuges. E, em vista da dificuldade da mulher ofendida em denunciar o seu agressor (por motivos diversos), torna-se difícil para o Estado punir estas agressões e solucionar o problema.Um dos motivos que inviabilizam a denúncia da mulher acerca da violência é a ineficácia do sistema penal. Por não acreditarem na punição do agressor e, além disso, terem medo de que a reação pós-denúncia seja ainda mais violenta, as vítimas optam por se manterem silentes.Diante deste cenário, o presente trabalho versará acerca das novas alternativas de solução destes conflitos e, em especial, através da mediação penal. Primeiro, será analisada a justiça restaurativa, seus princípios e sua aplicação através da mediação. Em seguida, tratar-se-á do crime de violência doméstica, sua natureza jurídica, como o ordenamento jurídico português enfrenta este delito e os motivos encobertos por trás de toda violência praticada contra a mulher. Por fim, na união das matérias estudadas nos dois primeiros capítulos, analisaremos, na terceira parte, a possibilidade da aplicação deste mecanismo alternativo ao crime de violência doméstica.É sabido que hoje, em Portugal, a prática da mediação penal nos crimes de violência doméstica contra a mulher ainda não é permitida. Apesar disto, o presente trabalho optou por expor os fatores que fortalecem essa proibição, rebatendo-os com argumentos que defendem o uso deste mecanismo de diversão.
