Homicídio Qualificado: contributos para a compreensão deste crime

Abstract

A presente dissertação enquadra-se na temática atinente à proteção da vida humana, o mais importante bem jurídico, consagrado na Constituição da República Portuguesa, e que se encontra previsto na Parte Especial do Código Penal Português. Mais concretamente analisa-se o crime de Homicídio Simples e o crime de Homicídio Qualificado, que se encontram respetivamente nos artigos 131º e 132º do referido diploma. O artigo 132º, sendo uma norma complexa, devido à sua estruturação, justifica uma análise do seu teor, de como está construída e quais as consequências da sua aplicação. Trata-se de uma norma que consiste numa agravação de outra, nomeadamente do Homicídio Simples, o que vai implicar uma maior moldura penal. É pois, uma norma, complexa porque se encontra dividida em duas partes; um critério generalizador, previsto no nº1, e um conjunto de exemplos-padrão, previstos no nº2. Vários estudiosos têm questionado a pertinência do alargamento dos exemplos-padrão introduzidas pelas várias revisões feitas ao Código Penal. Lançando mão de pesquisa bibliográfica, que nos aponta para algumas divergências doutrinais, e consultando a jurisprudência referente a esta temática, procurou-se perceber qual o intuito do legislador quando criou esta norma.O estudo realizado permitiu equacionar se nos exemplos-padrão está em causa um tipo de ilícito mais grave ou se, pelo contrário, traduzem uma culpa agravada. Ao mesmo tempo, questiona-se se o sucessivo alargamento desta norma lhe vem retirar o sentido original.

This dissertation approaches the theme of the protection of human life, which is the most important juridical right, established in the Constitution of the Portuguese Republic, which is provided for in the Special Part of the Portuguese Penal Code. More specifically, it analyzes the homicide and the aggravated homicide, which are respectively found in Articles 131 and 132 of said diploma.Article 132, being a complex rule owing to its structure, justifies an analysis of its content, the way it is formulated and the consequences of its application. It is a rule that consists in an aggravation of another, namely of homicide, which will imply a greater penal framework. It is, therefore, a complex rule, because it is divided into two parts – a generalizing criterion, provided for in paragraph 1, and a set of standard examples provided for in paragraph 2. Several scholars have discussed the pertinence of extending the standard examples introduced by the various revisions made to the Penal Code. By resorting to bibliographical research, which points us to some doctrinal divergences, and the jurisprudence referring to this subject, we tried to understand what the legislator's intention was when he created this rule.This study made it possible to determine whether the standard examples represent a more serious type of illegal action or if, on the contrary, they represent an aggravated fault. At the same time, it is questioned whether the successive enlargement of these standard examples will jeopardize its original meaning.
